If the state could have proved that, he would have gotten a far harsher sentence. The only thing the state could prove is that he was a chronic user due to his THC levels. If they had gone to trial, a jury may have believed the defense and failed to convict.
There is no way to prove the level of intoxication with THC since it is lipid soluble. Anyone who advocates the legalization of pot needs to read this story and understand the consequences of changing the law.
