If you and I chose to live together, have sex, share cars and houses and vacations and what-have-you, there's no viable law against that. We can call it a marriage, we can (in most places) adopt children, and live however we choose to live. We just can't obtain a state issued marriage license, because we don't fit the defintion. Just like we can't obtain a state issued semi-driver's license unless we meet the requirements, or obtain retirement welfare (social security) at the rate of people over 67 years old because we don't meet the requirements. Or obtain tax exempt status as a church because we don't meet the requirements.
But, we can live 100% exactly the same way.
