Technically both are correct depending on the context of how they are used.

Can one really be "in" an emergency?

My vote is for "having".

You people must hate America if you haven't voted yet.You are "in" a state of shock that could result in you "having" an emergency.

Unless you are in a state of emergency that could result in you going "into" shock.

You're welcome.

Let's put it in this context:

I am having a baby

I am in a baby

In "I am in an emergency", the word "emergency" should be used as an adjective. It would be correct to add the word "situation". In "having an emergency", it is a noun and is correct alone.

I like grammar nazis.

You should have said "Boy, I am glad I read all of the way through before posting", or "Boy, am I glad I read all of the way through before posting?".
