ANNAPOLIS | Maryland’s highest court ruled Wednesday that a law allowing in-state tuition for some illegal immigrants will go to referendum this fall.

The Court of Appeals ruled that the Dream Act is subject to a statewide vote, rejecting a lawsuit by immigrant advocacy group Casa de Maryland arguing that the law governs appropriation of state funds and cannot be petitioned onto the ballot.

the law governs appropriation of state funds and cannot be petitioned onto the ballot.

Ya know, this sort of argument is similar to the most recent tactics used by the camera traffic enforcement industry. The notion that there are aspects of government that are sacred, I mean reserved for the government alone, and mere mortals, I mean subjects, I mean citizens, may not interfere with, even through ballot actions.

Pretty scary idea. Seems to totally get away from "for the people, by the people", and go right into "each according to his needs" :wench:

When that constitutional scholar turned president complained that the constitution was to restrictive, it didn't allow governent to do things... I knew we were in trouble. If anyone has ever read anything about the drafting of the constitution, they would know that's exactly what the framers wanted. The constituiton restricts the government, and the government can only do those things it permits, all other powers are granted to the states and the people. Most state constitutions echo those sentiments.

Instead we have tried to replace those words with the words of Marx - we just don't like to use the S word or the C word.
