I'm not worried about that little bit of money.
I wrote you a basic F it thread with Fight Club and the forums because Im just so tired of the worlds mental retardation.. I've been getting it up my ass on a lot bigger scale than FC, by the same type of retarded ass women.
As you may or may not know I also own an ATV sales and service business. Now it's shut down too, because a bunch of retarded women just got a law passed banning ATVs and motorcycles for kids 12 and under.
These retards used the lead laws in toys to get it passed, because the battery and cable ends use lead.

Now I'm not allowed to sell the bikes I have in stock, I'm not allowed to sell the parts I have in stock.
I can't repair them, because no one else is allowed to sell the parts they have in stock.
Then you tell me that you might have to shut down Fight Club because some other retard is crying over a picture they posed for and has posted on my space.
Can Verizon be sued, because I use their phone to harass you?
Can Yahoo be sued, because I use their E mail service to harass you?
Are tabloids sued because they made a not so becoming picture of someone public?
Can anyone sue Remington because their ammo was used to shoot someone.
How about Smith and Wesson? Can they be sued too, because they made the gun that fired the Remington bullet?
The answer to all of the above are no. But they can try.

It seems to me that there is an important distinction to be made here.
If someone merely uses a system or product to harm someone else in an inappropriate, and legally recoverable way, then the person who owns that system or makes that product is not likely to be held legally responsible, unless such use was easily foreseeable and they were somehow negligent in facilitating that use.
However, if that owner or producer is put on specific notice about their system or product being used to harm someone, then their legal responsibility to take preventive action is raised. In many cases they might not need to do anything. But, in some cases, their failure to take reasonable actions to prevent their systems or products from being used to inappropriately harm someone, may legitimately open them up to legal liability. Assessing whether or not they need to take action is an imprecise process, so they often choose to err on the side or caution. The point being that an element which often differentiates situations, is having specific knowledge or notice - ignorance can be bliss.
It's kind of like sexual harassment claims. If an employer has no knowledge that someone is being sexually harassed in their business, and they haven't done anything to foster or promote such harassment, then they are less likely to be held legally responsible for that harassment. However, if they had knowledge, or had been put on specific notice - and failed to take appropriate action - then they are more likely to be held legally responsible. At the very least, the standards by which their actions will be judged will be different.
All that having been said, I don't know the specifics of what went on in FC - and I'm not much concerned about it - so I obviously don't have an opinion about the propriety of how it was handled. But, with the general notion that 'retards' suppress the enjoyment of the world for the rest of us, I think it is hard to argue.

The only thing that law accomplished is putting kids at more risk because they will now being riding adult bikes that are way to big for them to handle.

The bikes Gumbo sold were marketed, created and sold specifically for kids 12 and under.
Back in the ... 80's (?) kids were getting hurt on 3wheelers that were to powerful for them (supposedly). One of the Government agencies (dont remember which) determined kids under 15 should be limited to ATV's that were under 90cc's. Kids under 12 should be limited to ATV's that were under 50cc's (no matter what the parents thought). The same ruling did NOT apply to dirtbikes it only applied to ATV's.
Suzuki and Polaris came out with a 50cc quad that was halfway decent, and the Korean clone market (no knock on whatever Gumbo sold) took off and created off-name versions of that setup. They also have 90cc atv's that were similiar. Realistically a 90cc atv is more suited to a kid 12ish, not a 15 year old (but still should be up to the parents).
Now kids will only have more powerfull ATV's available to them, as long as the parents ... fib about who they buy them for, which undermines the original intent of the 80's government agency ruling.
A under sized and under powered bike or ATV will get you hurt quicker than an over sized or over powered one.
The suspension must work either way. You must weigh enough to make it work properly. But when you weight to much it bottoms out and you lose control. If it don't have enough power to go up a hill, you go backwards. If it don't have enough power at the rear wheels to go around a turn , it push's in the turns.
The age laws for size bike are as retarded as the retards pushing the laws.
a 12 year old can range from 180 to 75 pounds
A 90cc has a max rider weight of 75 pounds @ 12 I was 5,10 145. And a 110cc wouldn't pull me up a hill.
Most MX racers on the circuit today were racing by the age of 10 on full sized bad ass 125cc made for racing MX bikes..
The issue still falls upon responsible adults..Responsible adults and their children suffer at the hands of the irresponsible retarded ones.
Every child tragedy involving and ATV I have ever read about is due to negligent parenting.
2 year old dies riding ATV.. Mother uses remote kill switch causing bike to over turn.. She should have been charged with criminal negligent.
Her child could not control his bowel movements yet, but she felt he could control a motor vehicle. And the bike had stickers all over it stating no one under 6.
There are millions of family's that spend the week ends with their kids trail riding. And spending time like this with your kids is the most import thing.
It's priceless time that keeps parents in touch and involved with their children's lives. These are responsible adults raising responsible kids to be responsible adults.
These are the people suffering from these idiotic laws. Not the trailer trash toothless retards that just buy their kid a dirt bike and turn him loose.
It only took 3% of our nation to remove the word God from our schools and courts.

It is a shame that what used to be the greatest country on earth is now ruled by the minority because the majority fear lawyers and out of control tort judgements, because the majority fear "offending" someone, because the majority continues to sit apathetically believing that "surely, that law won't get passed".
As long as we sit meekly by and do nothing to get involved or to speak out in all venues, we will continue to be ruled by the "squeaky wheels".
The lead law was hastily passed and poorly thought out and executed. The way it was written has resulted in several challenges already, one of them by the American Library Association because the wording actually banned all existing children's books unless they had been tested for total lead content. Gumbo, check with the ATV manufacturers to see if they are moving to challenge any provisions of the law.
As for FC, I guess we really have lawyered the 1st amendment out of existence. just MHO...:whistle:

You're absolutely right. There were definitely a few people in FC that needed to have the hammer dropped on them. Key words here are, "a few people". Why did FC have to get taken away from everybody? Ban the #### out of the troublemakers & be done with it.
I vividly remember the first few times in elementary school that somebody did something bad (who knows, threw some gum at the board or something?), and the teacher didn't catch them. And then came the horrible words, "well, if nobody can tell me who did it, then we just won't go out to recess" WTF! I didn't do it, don't know who did, and I'm not telling you even if I did just to catch a beat-down from the kid that did it.
That's about all you'll hear from me on the subject, cause I'm not premo & it's not like I'm out any money if I don't like a decision that's been made here. As is often stated, if I don't like it I can leave. Just the principle of it bugs me, though.

It is amazing the amount of "private" information that is already out there on the Internet, much of it voluntarily posted by the "person" themselves.
I totally understand your desire to avoid any possible legal issues that could cost you your livelihood. You have set up rules and consequences in an effort to maintain a modicum of control -- wise move.
Unfortunately, the Internet and everything associated with it is growing exponentially and it is very difficult to keep up with all of the new developments and still have time for a life. There are still many people out there who don't understand the number rule of the Internet : don't post anything that you wouldn't want to see broadcast on the national network news for the next 100 years. The Internet does not go away just because you change your mind about something you post. It is there and searchable forever.
Perhaps you might want to add a disclaimer to each page of your site saying something to that effect so there's an IN-your-face reminder. Of course, that still won't keep you safe from lawyers and idiots.
I do commend you for taking a stand. I simply abhor the fact that it was necessary for you to do so to protect your livelihood while negatively impacting people who were able to maintain themselves according to the rules.

No offense intended here but would it not weaken, if not collapse any lawsuit that you may have to defend, if the plantiff had not requested to be a member of the in question private forum?
I can understand if the person who's image's had been posted or who's reputation may possibly have been damaged and was never a member of a personal or private forum .
In this case a lonely woman who was clearly unhappy in her home life chose to strike out of her comfort zone, meet up with some peeps and in the end got called out for not fitting in. That does not in anyway excuse the poor behavior of the folks she chose to hang with.
I hear the words ringing in the back of my head like my mother did when I was young. "Take it to Fight Club" You are the boss my lady and I and most others will respect that. I just don't think that fear of the what if should rule the right now.

See, there's the problem - I do not want to defend a lawsuit over something so silly that could have been very simply avoided.
Free speech does not include the right to defame someone or make their personal information public. Had the photos been removed and the members warned not to continue posting them, I wouldn't have even known they existed and wouldn't be involved in this at all. It's literally as simple as that.
