Two things:
1. Call Animal Control, make a compliant. At least then it's on record. I unfortunately have gotten one of those notices when my Husky x started jumping our fence and running the neighborhood (this was stopped with the addition of an invisible fence around our physical fence), but I was mortified to receive a notice from AC that Savannah had soiled on someone else's yard :( I got the notice on my door and had to contact the Officer to explain why my dog was out :( How embarrassing - we had just moved in and must have been #1 on our neighbors list after that :(
I know my BIL is a ACO over in Charles and he often gets calls on the same dogs daily and basically knows he needs to drive that neighborhood at a certain time of the day to find the dog :( So I would definitely make a call.

2. DON'T SHOOT THE DOG with a pellet gun, no matter what your husband says I know I was planning on becoming Annie Oakley myself when my neighbors dog (who was out all the time) jumped MY fence and killed two of my chickens I told my BIL I wanted to get a pellet/paint ball gun for that dog or any other that was thinking of coming in my yard again, and he said while I could shoot it dead (that sounds so lovely doesn't it ) for coming after any of my pets, I'm not aloud to "torture" the dog w/ pellets/paint balls. I just wanted the dog to remember not to come by our house anymore, not kill her.... geesh...
But honestly I'm sure they know they're dog is using your yard, and while it's hard for me to put this into practice I TRY to remind myself that if someone is gutsy enough to do something that makes me uncomfortable or upset I should be gutsy enough to say something back.....
This is a lot harder to do then to say, I'm getting better and I would really recommend doing that first. Of course once it's done they'll know it's you that has made the compliant (should you still have too), but if this dog is regularly using your yard I still have to believe they are already aware of it and they would know anyway. But you are still taking the higher road by giving them a chance to fix the problem - if they don't report it.

Take photos with a date/time stamp on image and take them to Animal Control and file complaint.

Plus I vote the mouse trap trick!!!

Just tell cops.."Gee..I have a problem with moles and other rodents..didnt think I would catch a dog!!!"

I vote taking pictures.

If you put out mouse traps, then do me a favor and call me wildlife queen and tell her you have some orphaned squirrels and have her come over and walk your property in each and every spot you have placed a mouse trap and hopefully they will flip on her foot and break a toe or something. What a hypocrite.
