Ok, never had to go through this so I don't know, when they say "field sobriety test" is that the touch your nose, stand on one foot deal or does that include the breathalizer?

Because if it was his medication, then couldn't that make him fail the field test if the breathalyzer is not included?

Uh yeah, I spelled breathalizer 2 different ways, sorry, not sure of its spelling.

If accident was caused due to his meds then why would you plea guilty?
I don't believe the, to spare the victims family thing.

He also said he took Benadryl before driving. I don't know about anyone else, but I can't even safely walk after Benadryl.

Regardless, he has a history of poor judgement and an innocent suffered for it.

If the state could have proved that, he would have gotten a far harsher sentence. The only thing the state could prove is that he was a chronic user due to his THC levels. If they had gone to trial, a jury may have believed the defense and failed to convict.

There is no way to prove the level of intoxication with THC since it is lipid soluble. Anyone who advocates the legalization of pot needs to read this story and understand the consequences of changing the law.

and if he was innocent his lawyer would have NEVER let him plead out.
