One thing to keep in mind is that the non custodial does not get the tax breaks that the custodial parent gets. Think about it...the non-custodial parent pays child support on an after tax basis. The custodial parent receives this money tax free while also claiming the child on her taxes as well as daycare expenses. link

It is hard to get it stopped. My husbands daughter was 19 and had a child of her own before it finally stopped. She was constinently skipping school and poor grades, getting her held back and as long as she was in school, he continued to pay.

Thank you!!!! That is all I was looking for, a reason for the madness! I figured that I was overlooking something...the law was not making sense to me.

But, what if you alternate years with taxes? Then that would go back to the original question.

Well, the SAO could only say it was the state law. CSE directed me to the SAO.

You can always get a change if there is just reason, such as loss of job or something but it has to be a certain percentage of a difference. In her case, she has no case if what you state is true.
