When my ex and I divorced he was told that he couldn't claim the kids on his Income Tax but he could claim the money he paid for the Child Support. That was in Virginia though.

Alimony can be claimed but child support can not in Maryland.

I take it you don't do your own taxes. Taxes are federal, state judge has no say. If you have the kid for more than half the year, you, legally, are the only one that can claim them. Otherwise, it's called tax fraud.

I have seen it written into many court orders that parents rotate years or each get a kid etc. Their is a form that a CP has to sign off on that allows the NCP to claim them.

It is quite uniform amongst the states as alimony (paid or received) is an adjustment to income and the state forms use the adjusted income from the Federal return, so you are claiming alimony paid out or received.
