Freedom Of Information - Drunk Bus Driver

Request for Reports of Driving Complaints Against Drunk Bus Driver Denied | Southern Maryland News Net

Question: Given the reader response and multiple assertions of previous complaints about the bus driver and arrest story yesterday and updated today, we are requesting all documents and information under FOIA concerning complaints,reports of dangerous or reckless driving, SMCPS actions and discipline for bus #603, Driver/Contractor Ethel Q. Ressler and other bus drivers/buses employed under that specific contract.


Answer: ...With respect to your request for documentation "concerning complaints, reports of dangerous or reckless driving, [and] SMCPS actions and discipline," any such records would be maintained in the personnel files of the drivers in question and, thus, are prohibited from disclosure pursuant to PIA Section 10-616(i).

That is like asking my DR. to give you my medical information, not going to work. I think I have seen cops shows long enough to understand you need to go through the court system for something like that. Other than that you can only get court filed records online of this person.

use the Maryland Judiciary Case Search. I can't guarantee it's 100 percent accurate (as I am sure data entry mistakes have been made),
But there are only 2 reasons charges won't show up, records are somehow expunged or a mistake was made.

But we are discussing citizen complaints about a person indirectly eomplyed by the state. Even if the school systems actions taken, or the company she works for are, I would think the complaints themselves, having most likely been called into the school system, are therefore public records and subject to under the MD equivalent to the FOIA, the MPIA.

I know that the anti-speed and red light camera crowd, including the Baltimore Sun, has had a helluva time getting requests filled, in blatant disregard of the MPIA.

Not sure of the exact flow, but I seem to recall that complaint calls go to a county office, in which case the below applies, I think,

Yep. Basically, personnel matters are none our business. Court records on the other hand? They're public.

Interesting story, made Southern MD news. If I were Board of Education her azz would have been fired the first bus driving incident with under the influence. Whatever happened to common sense, no wait let her wreck a bus for and injure some children and then we can take action.

Let me clarify. She has not been convicted. Violation date 12/13/12. Trial date 12/13/13.
