That call he is on could very well be police business. Should they be equiped with a hands free device? Probably. He also has a police radio w/microphone plus maybe a radar unit to watch. Some jurisdictions have computers to operate, now that is a real attention grabber. I think they do pretty good for what is asked of them.

Yea, driving with a cell phone is legal. We should look at the big picture and all the laws they are actually breaking while working.

Speeding
Improper lane change (no signal)
Turning on emergency lights to go thru a red light and then back off. (And no it was NOT an emergency)
Following too closely
And just all around driving like idiots

Add:
No signal when making a turn
Failure to stop at a stop sign
Failure to yield to oncoming traffic
Failure to keep right of the center line

Okay so its legal and yeah they do a good job. But..... why then are we constantly bombarded with reports not to drive and use the phone w/o a handsfree device? Why are states passing laws making it illegal to do otherwise if it is safe? How can you teach safe driving to your kids and then have them see law enforcement breaking it. By the way he was turning into the Governmental Center - like on his way back to the station.

Yeah they break alot of other traffic laws and everytime they do the public should call them on it. I guess it just pissed me off to see this on my way to work this morning.

Don’t worry, if Maryland ever passes a law that makes it illegal to drive and talk on a cell phone cops will be exempt like they are for driving and operating a computer.

How many states is it illegal in? I know New York, do you have any others?

From http://mobileoffice.about.com/cs/tra...gcellphone.htm

It's important for mobile office professionals to be aware of the fact that many jurisdictions have made it illegal to use your cell phone while driving. In some cases you can still use handsfree devices.
Ignorance of the law is no defence, so make note of where you cannot use your cell phone.
  • In Newfoundland and Labrador it is illegal to use a hand-held cell phone while driving.
  • Brooklyn, Ohio have passed an ordnance making it illegal to use handheld cell phones.
  • Marlboro, NJ prohibits the use of hand-held cell phones.
  • New York is the only state which has made it illegal to use hand-held cell phones.
  • Washington DC bans the use of hand-held cell phones.
Countries which have banned hand-held cell phone usage:
  • Australia
  • Brazil
  • Israel
  • Italy
  • Japan
  • Spain
  • United Kingdom

It is not legal to use a hand held cell phone on PAX by order of the CO, but people do it all the time (me too - have to remember to wait).

I saw an officer litter in front of me. He put his hand out the window, opened it up, and a wadded up napkin came flying back at me.
