Key is the word "unattended", which for reasonable people means - "not being attended to, looked after, or watched". As the law does not specifically define the term and its intended use I think those with remote starters, where the vehicle is locked on their property, or those that start and lock the vehicle returning to the warmth of their home while waiting for it to heat up in the driveway might be able to argue that the vehicle was not unattended.

Another defense using the law itself is the vehicle was locked, the steering wheel was locked, the keys were removed..... The only requirement not met was the engine was not shut off.

So if Joe Thug breaks the window & tries to drive;
1. he cannot turn the locked steering wheel.
2. without the key, the vehicle shuts itself off after 30 minutes or so.
