Taking down a tree

Anyone know the legalities? I have one in my front year that grew kind of cockeyed and hangs over the driveway. In the winter when it snowed it blocked the drive. It's an evergreen and just plain ugly and of no use. It's fairly small; maybe 8 ft tall, 4-6 inches in diameter. It would be easy to just cut down but is it legal?

It depends a lot on where you live. Critical area?
