HELP-Car That Rear Ended Us DIDN'T Have Insurance

We were rear ended in an accident on Saturday, myself & 2 kids were sent to the hospital. My husband was OK, my kids were seen at the hospital and deemed OK. I was injured, back was thrown out and am home on bedrest.

I am out of work for a month and have to have someone at home with me at all times, I have a 18mth old to take care of.

We have found out that the people who hit us DO NOT have insurance and my PIP is ONLY $2500.

What do I do? They were YOUNG, I think like 20-22.

Who was the car titled to? Did it have valid tags? (Which it couldn't if there was no insurance on the car.) What state? Was the driver just not insured, because insurance follows the vehicle.

Sorry to hear about your back, but glad everyone else is ok.

I'd find out how old the driver was.. no insurance someone has to have financial responsibility, and if he's under 18 (21 MAYBE) then it's the parents.

I'd talk to a lawyer.

Have you contacted your insurance company? You should have uninsured motorist coverage.

You really should contact a lawyer just to be sure you don't do something that will void your rights.

The car was titled to a young lady (maybe 20-22) who was in the passenger seat, the driver was a young man age 24. They were tagged in MD.

I DO HAVE UNINSURED Motorist Insurance on my car, BUT that only covers PROPERTY damage to my vehicle, not medical, loss wages, etc.

Who didn't have insurance?

Your personal injury attorney in Maryland makes a claim against both the at-fault driver and your own insurance company.

Taken from Kwillia link.. If you have uninsured coverage you do the above..

What Compensation Can I Get for My Uninsured Motorist Claim?

The one question most frequently asked is will my uninsured motorist auto insurance policy cover my pain and suffering as well as my lost wages and medical expenses. The answer is yes. The purpose of the coverage is to put the victim in the same position as if the uninsured motorist who negligently caused the auto accident had car insurance sufficient to pay the damages incurred by the victim, including pain and suffering damages that the victim incurred as a result of their personal injuries from the accident.
