It's all moot. He won't be prosecuted. Generally the witnesses have to testify, which they won't. The baby is evidence, but there's no telling where it was conceived. They live in Louisiana, they work in California, I assume. They do other traveling probably all over the country. The people involved could claim they only boinked in states where it is legal to do so. It would be difficult to prove otherwise.
