I never once claimed the FISA Executive Order was for U.S. persons. By you saying that it was a "law" clearly indicates you have no idea what an Executive Order is in the first place. Am I to believe you are so naive that you actually think U.S. persons are not collected on with proper justification? I will concede there is, in my opinion, there is no need for warrantless wire tapping. There is a checks and balance in place called the FISA court. There should be protections for companies that provided such information. You wrong wingers just want to open the gates for tort lawyers to redistribute wealth by going after said companies.

Levin is referring to Clinton’s 2/9/95 executive order and his claim is totally false. First, FISA didn’t cover physical searches at the time, so the executive order did not, and could not, “bypass FISA.” Second, unlike the secret Bush administration program, Clinton’s public executive order did not apply to U.S. persons. If Bush’s program didn’t apply to U.S. persons there would be no controversy at all.
But Levin doesn’t have to read Think Progress to figure this out. He can read his own right-wing magazine. Here’s the National Review’s Byron York five days ago:

In the argument that has emerged over warrantless surveillance, there have been a number of overstatements. Some people, for example, have said that Bill Clinton signed an executive order authorizing such surveillance; he did not.

One clarification: when someone says something that’s not true, it’s not an overstatement, it’s a lie.

What we'd get with an all Democratic administration is another FDR, trying to pack the Supreme Court to get legislation as law the Socialists can't get legislated. We'd get the same government we have in Maryland, an out of control Legislature and Governor (who by the way, just got his pee-pee whacked for illegally firing a Police Chief as mayor).

Just how did Kennedy's war make us safer? How did Johnson's war make us safer? How did Clinton's inaction make us safer? How did Carter's inaction make us safer?

Hey, if I thought we'd get another FDR for president I'd be going door to door to drum up support. FDR saved this country and brought it out of some of the worst times it's ever seen.

All of his good work is steadily being undone: poverty is creeping back, Wall Street is getting government handouts for their stupidity, the Paris Hiltons are collecting this nations wealth and giving little in return, etc.
