Faceoff set over death at Phoenix airport

"Phoenix officials rejected an $8 million wrongful-death claim from the family of Carol Gotbaum an hour after it was filed Wednesday, and they issued a strongly worded letter laying the blame on her husband for letting the troubled New York woman fly to Arizona alone.

Gotbaum, a 45-year-old mother of three, died in a Phoenix police holding cell at Sky Harbor International Airport last September after being taken into custody over a disturbance at a departure gate. Shortly after 1 p.m. Wednesday, attorneys for her husband, Noah Gotbaum, filed the wrongful-death claim, a precursor to a lawsuit.

The claim alleges that police violated national police procedures and their own internal rules by using "excessive and unreasonable force on Carol, as if she was a dangerous criminal, rather than as the sick, intoxicated and vulnerable person she was." It also alleges that Gotbaum was improperly cuffed."

It should be thrown out of court especially for the reason they gave - just shows how greedy people can be to try and get $$$ from others w/o taking any blame on themselves.

Well, you do have to feel bad for the children because they are young and did lose their Mom. Even though she had an alcohol addiction you don't know how she was w/her children to judge her. Rehab does help many where maybe she could have been helped and many can overcome alcoholism. But it's too late now because her family allowed her to travel alone knowing she was not stable.

Sorry, even if you're sh!tfaced drunk, drugged, crazy or crippled, the Po-Po's assume responsibility for your safety after they haul you in. Not that there isn't a lot of blame to spread here, but the fact is she died in their custody. It'll be interesting to see how this plays out.

Well, in reality I wouldn't consider June Cleaver to be the ideal Mom. She never raised her voice and put up w/everything Ward said.

Either way, she had an addiction and was going for help for it. But I don't think you should judge someone on how good of a parent they are w/o knowing the facts. But I agree in many ways she caused her own death and I do think her husband, family member or friend should have been traveling w/her.

Not buying it.. if a cop handcuffs you in the back of his car, and you choke yourself to death trying to escape.. tough titties.

You're dead, we save taxpayers money.. win win..
