Why is it when one person is accused of doing something illegal, that there are people in our society who question decisions by the victim which would be perfectly legal! There is no crime against being out in the early hours of the morning!

I think it has to do more with questioning parental involvement. If you set the leash free and let kids run at will, they will and it is trouble just waiting in the winds so to speak.
