I stand corrected. In looking closer, the difference between 1st and 2nd degree is the use of a weapon, inflicting serious injury on them, or leading them to believe they can and will inflict serious injury on them or on someone they know. Or kidnapping the person or during the commission of another crime or with the help of another person.
