| I'm waiting. I'm having dinner with Justice Kennedy next week, gonna see if I can get a read off him. Back to the real world... I'm still thinking about it. I see it as very close, though oral arguments may have moved me from close but leaning uphold to close but leaning strike down. When I get a chance, I might listen to the arguments again to see if I missed anything that might be a strong tip-off. Once I do, I'll offer my guess. It will most likely be the first or third option, though I wouldn't rule out the fourth.

| So, does anyone have any predictions on other aspects of the cases? Will the Medicaid provisions be upheld or found to be in violation of the Constitution? Any thoughts on vote split?

| BTW, I don't think that Obama's and a few Senators slamming and threatening the SC is going to help their cause. Listening to the hearings makes me think Gingsberg is about ready to kick the bucket. |

| The Supreme Court hasn't released as many opinions as I would have thought during the last couple of weeks. We may not get the health care decisions until closer to the end of June.
