Court rejects bid to have Marijuana reclassified

The appeals court panel denied the bid from three medical marijuana groups, including Americans for Safe Access, and several individuals. In 2011, the Drug Enforcement Administration had rejected a petition by medical marijuana advocates to change the classification.

"Because the agency's factual findings in this case are supported by substantial evidence and because those factual findings reasonably support the agency's final decision not to reschedule marijuana, we must uphold the agency action," the court ruled.

DEA regulations define "currently accepted medical use" to require, among other things, "adequate and well-controlled studies proving efficacy."

Americans for Safe Access cited more than 200 peer-reviewed published studies demonstrating marijuana's efficacy for various medical uses, including a 1999 study by the respected Institute of Medicine, a government adviser on health issues.

"The IOM report does indeed suggest that marijuana might have medical benefits," the court conceded. "However, the DEA fairly construed this report as calling for 'more and better studies to determine potential medical applications of marijuana' and not as sufficient proof of medical efficacy itself."

What, in the history of the world, would lead you to believe that the government would willingly give up their cash crop?

There is way too much money to be made by keeping the pot illegal. If they legalize it, the only people who stand to make money are Frito-Lay and whoever brands marajuana cigarettes first. Major uncool.

regardless of my personal opinion of marijuana being legal, that right there is the reason that our medical costs are so high.

personally, I do see a use for it in the medical field, so I think it should be legal to use for certain things, however like most medications that actually work, I dont think it should be legal for recreational reasons.

as far as questioning if it is harmful to people, I would think that considering the 60s, through today, enough research or observation should already have been had.

When a Libertarian becomes president?

I don't know. I thougth the left was supposed to be tolerant on social issues, Marijuana being one of them. Unfortunately, I'm sure all the high ranking brass in the DEA, and the like are doing the best they can to make sure it doesn't become federally legal, or even declassified.

then restructure the way drinking is handled and throw MJ in with it.
transport only in closed sealed containers, use only at home.
Shut down bars, restrict drinking and smoking anywhere in public.

I've tried that argument here.

I'd say a good 80% of the people here are absolutely convinced that if marajuana is legalized, the first thing that will happen is that damn near everyone over the age of 12 will immediately get high, and proceed to careen down the highway killing everything in their path.

do you agree that there is already enough problems with drinking and driving? why would we want to do something to increase that problem, and do it with something that cant be easily tested for on the side of the road?

Impared driving, is impared driving. I understand that, but plenty of people can go out, have a beer or 2 with dinner and drive home just fine.
and Im sure there are people that can smoke a little weed, and drive ok, but what about those that cant?
again, we already have the drunk drivers, but at least they can be tested on the side of the road and get an immediate readout of their level of intoxication

How do we handle the dopers that get totally toked up and then drive? How do we test them on the side of the road to take them from behind the wheel?

and another problem is that weed will stay in your system for some time, so even if they do get dragged down and tested, and the results are positive, how do we determine in court that what was found was not residue from the night before.

As I've said before, I do not believe it will increase the problem. The only jackholes who will drive impaired on pot are the same jackholes who drive impaired on alcohol (and pot) now. This will not influence the jackhole to normal person ratio.


And the ease of testing is something I couldn't care less about. If they have to draw blood, or test spit, or do anal probes, then oh well. They'll figure something out. They always do.
