As I understand it, its quite clear that the White House instructed the CIA to retain the tapes....

They are official government records that must be kept, but unlike the missing email that the White House intentionally erased, the only folks in legal jeopardy over disclosure of the tapes would have been CIA employees...so why would they take the risk and instruct the CIA to erase them??
