But there is no reason for Obama to lay down for nuisance lawsuits either. Just because a guy has the $350 to file a suit, doesn't mean it has any merrit.
have there been any rulings on the various "motions to dismiss"?
Nope, no rulings yet on the motions to dismiss. Obama isn't laying down, as it is obvious he is trying to fight it by filing those motions as well as a motion for protective order staying discovery pending decision on dispositive motion.

If there is no merit or nothing to hide, why give the impresion that there is?

i dont think that using your rights under the law gives the impresion that he has anything to hide.

do we think a defendant is more guilty when he has a lawyer, or is it just his right?
This is just the same.

it makes sense that his lawers would request a stay on discovery until there is a decision on the motion to dismiss. if the case is ultimately dismissed, why do we need to go through any of the other motions?

If there was nothing to hide, and given that it is a requirement to become President that one must be a natural born citizen, openly disclosing the information would squelch all doubt. Fighting the filing does give an impression of hiding the truth, at least in my mind.

yeah, but you are looking for a reason to doubt, considering the documents have been published (more than i can say for others in the race- unless one of you can link to Mccain, Palin, or Biden's birth certificate)

like i said, it is his right to have the aide of counsel. why wouldn't he use it?

Because he has no reason to spend thousands of dollars in legal fees when asked to produce a document that the state will issue for $5

Unless he wasn't actuall born in the U.S.

you could apply for that same document for the same $5.....

and from Ken's post, it doesn't seem that would satisfy the complatant

would it satisfy you to see the actual document?

BTW, i am sure the money for his "defense" in this case is coming from the campaign.

You're right! I still don't understand why Sarah refused to testify in Troopergate either.

You didn't read the report, did you, because she wasn't asked to.

She originally didn't, she actually filed the charges against herself to get the investigation going and out of the way.

Then, when the investigation was being taken over by the Obama campaign, and was going to clearly be non-partial, she decided to wait until there could be an impartial investigation.

But, COLB or not, none of this addresses the Indonesian citizen issue - the one that probably has some merit to it.

For $5 all you get is a letter of verification that a certificate exists. Secondly what one receives when requesting a birth certificate, say to replace a lost original birth certificate, is a state issued document and not a copy of the original birth certificate. So you are right, it probably would not satisfy the Berg complaint.
