Of course he needs to explain this, but in the context of his claim "Guantanamo should have never happened in the first place" I want to know what he would have done otherwise with capture enemy combatants. If he going to accuse Bush of breaking the law and claim he did it all wrong I want to know how he would have done it differently.

If we'd have had a better candidate, this very question would have been asked of Obama during the campaign;

"You say you oppose the invasion of Iraq, yet, contrary to what your supporters think, you weren't even there for the vote. Yet, you then voted to support it every single time money was asked for to conduct it. That sounds just a tad inconsistent, yes? If you are against something, you'll still support it because it was done before you arrived? or because it was a tough call? Not much of a record of courageous stands for a campaign of change, is it? So, when, if you win, fat chance that, will that become the excuse on other tough issues that require courage of conviction, you're against it, whatever it is, but, if it's a tough one, so, you'll still just go along with it and support it anyway?"

If I understand you correctly (and are we back on this again?) the GOP had a chance to put a better candidate in there. They chose McCain. However, I'm certain if McCain we in the WH we wouldn't even be talking about this.
