"Nut" Shell Obama Gun EO

In an effort to touch on all four of those elements, the president recommended:
  • requiring criminal background checks for all gun sales (a national registry)
  • reinstating the assault weapons ban (under the new definition for assault weapons where all semi-automatics are considered “assault – See Fienstein Bill)
  • restoring a 10-round limit on ammunition magazines
  • eliminating armor-piercing bullets (also caliber restrictions)
  • providing mental health services in schools (and required reporting)
  • allocating funds to hire more police officers (federal) and instituting a federal gun trafficking statute, among other policies.

Statement by Gov. Perry on President Obama’s Executive Actions

Wednesday, January 16, 2013 • Austin, Texas • Press Release

Gov. Rick Perry released the following statement regarding President Obama's executive actions:

"The Vice President's committee was appointed in response to the tragedy at Newtown, but very few of his recommendations have anything to do with what happened there.

"Guns require a finger to pull the trigger. The sad young man who did that in Newtown was clearly haunted by demons and no gun law could have saved the children in Sandy Hook Elementary from his terror.

"There is evil prowling in the world - it shows up in our movies, video games and online fascinations, and finds its way into vulnerable hearts and minds. As a free people, let us choose what kind of people we will be. Laws, the only redoubt of secularism, will not suffice. Let us all return to our places of worship and pray for help. Above all, let us pray for our children.

"In fact, the piling on by the political left, and their cohorts in the media, to use the massacre of little children to advance a pre-existing political agenda that would not have saved those children, disgusts me, personally. The second amendment to the Constitution is a basic right of free people and cannot be nor will it be abridged by the executive power of this or any other president."

Your title and your content do not match. Your title stresses the executive orders...your content is only the recommendations...do you understand the difference??

As for the actual orders here they are from your link:

1. Issue a Presidential Memorandum to require federal agencies to make relevant data available to the federal background check system.

2. Address unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act, that may prevent states from making information available to the background check system.

3. Improve incentives for states to share information with the background check system.

4. Direct the Attorney General to review categories of individuals prohibited from having a gun to make sure dangerous people are not slipping through the cracks.

5. Propose rulemaking to give law enforcement the ability to run a full background check on an individual before returning a seized gun.

6. Publish a letter from ATF to federally licensed gun dealers providing guidance on how to run background checks for private sellers.

(Note that the first 6 orders deal with strengthening the background check system. This does not infringe on anyone's rights)

7. Launch a national safe and responsible gun ownership campaign. (isn't this part of what all you gun nuts say? "good guy" with a gun??)

8. Review safety standards for gun locks and gun safes. (OH Mr. Obama you socialist you!)

9. Issue a Presidential Memorandum to require federal law enforcement to trace guns recovered in criminal investigations. (huh...tracking the source of guns used in crimes...what a liberal idea)

10. Release a DOJ report analyzing information on lost and stolen guns and make it widely available to law enforcement.

11. Nominate an ATF director.

12. Provide law enforcement, first responders, and school officials with proper training for active shooter situations. (Go ahead...argue you that one. say its illlegal...how the "little dictator" is overstepping his powers!)

13. Maximize enforcement efforts to prevent gun violence and prosecute gun crime. (In other words...enforce the laws already on the books...where do I see that refrain everyday?)

14. Issue a Presidential Memorandum directing the Centers for Disease Control to research the causes and prevention of gun violence.

15. Direct the Attorney General to issue a report on the availability and most effective use of new gun safety technologies and challenge the private sector to develop innovative technologies.

16. Clarify that the Affordable Care Act does not prohibit doctors asking their patients about guns in their homes.

17. Release a letter to health care providers clarifying that no federal law prohibits them from reporting threats of violence to law enforcement authorities.

18. Provide incentives for schools to hire school resource officers.

19. Develop model emergency response plans for schools, houses of worship and institutions of higher education.

20. Release a letter to state health officials clarifying the scope of mental health services that Medicaid plans must cover.

21. Finalize regulations clarifying essential health benefits and parity requirements within ACA exchanges.

22. Commit to finalizing mental health parity regulations.

23. Launch a national dialogue led by Secretaries Sebelius and Duncan on mental health.

So come on...where are all you 2nd amendment folks who have been whinning and complaining since Sandy Hook? Where is your outrage over these executive orders? It was all over this site prior to the release....

None of these take away your guns.

None of these take away your rigths.

Most of these deal with the same topics you have been asking for.

Protected Health Information. The Privacy Rule protects all "individually identifiable health information" held or transmitted by a covered entity or its business associate, in any form or media, whether electronic, paper, or oral. The Privacy Rule calls this information "protected health information (PHI)."12

“Individually identifiable health information” is information, including demographic data, that relates to:
•the individual’s past, present or future physical or mental health or condition,
•the provision of health care to the individual, or
•the past, present, or future payment for the provision of health care to the individual, and that identifies the individual or for which there is a reasonable basis to believe it can be used to identify the individual.13 Individually identifiable health information includes many common identifiers (e.g., name, address, birth date, Social Security Number).
So you're saying we need to trade a little more freedom and privacy for some imaginary "safety" like they have in Detroit to fix a problem that really doesn't exist

And let me be absolutely clear. Like most Americans, I believe the Second Amendment guarantees an individual right to bear arms. I respect our strong tradition of gun ownership and the rights of hunters and sportsmen. There are millions of responsible, law-abiding gun owners in America who cherish their right to bear arms for hunting or sport or protection or collection.

This is a total distortion of the 2nd Amend. and the meaning behind it. Lets play this game. "he did not say he was attacking the 2nd Amend" Sure, that is how Obama works. He spells everything out and is transparent.

Sorry, game over, liberals and the Obama admin are out to restrict the 2nd Amend.
Let me be clear: I'm fixin' to lie my ass off, right to your face.

For an alleged professor of constitutional law, he sure doesn't seem to know much about the constitution.
