Man Charged with Aggravated Animal Cruelty in Death of Dog at State Park

A St. Mary's County man was charged Tuesday with two counts of animal cruelty after he shot a dog and cut its throat at Newtowne Neck State Park on Christmas Day, the Maryland Natural Resources Police said.

Marcus S. Stauffer, 20, of Leonardtown was deer hunting from a tree stand when he saw the dog, a year-old Chesapeake Bay retriever, and shot it twice with a muzzleloader. He climbed down from the stand and cut the dog's throat.

The dog and another retriever are owned by the ranger who lives at the park. The dogs, which wore collars and tags, were confined to a porch while the ranger patrolled the park but broke free.

The ranger found the one dog and, with along with a Natural Resources Police officer, searched the park for the second dog without success.

Hours later, the ranger encountered Stauffer, who said he thought the dog was a stray and that he "shot it for the public."

He and a family member retrieved the dog's body from a marshy area.

The charges of animal cruelty, aggravated animal cruelty and destruction of property under $1,000 were reviewed and approved by the St. Mary's County State's Attorney and Stauffer was served with a criminal summons yesterday.

A preliminary hearing is scheduled for Feb. 26 in St. Mary's District Court. If found guilty of all three charges, Stauffer faces a maximum sentence of three years and a fine of $6,500.

The Department of Natural Resources Wildlife and Heritage Service has rescinded Stauffer's permit to hunt on southern Maryland public lands that require a permit.

How about the Ranger should have kept his pets under control and not running loose.

Here's a clip from rules using MD State Parks,

All pets must be licensed and have all required vaccinations, including a rabies vaccination.
Pets must be leashed. Pets may be off-leash and under voice control while swimming in designated areas or hunting (with the appropriate permit).
Pet owners must clean up after their pet. Waste disposal containers are available in most areas.

The Ranger has to live within the law also..

I guess no one remembers the pack of wild dogs running around southern St. Mary's a couple of years ago scaring the #### out of the community. Good on this guy for thinking of the greater good of the public!

The dogs were confined but broke free...when hunting--you need to know what the hell you are shooting...he knew it was a dog......

He cut the throat of a collared dog because it was a 'stray'. Dumbass. I guess that's the downside if your family tree doesn't have branches.

Growing up in Western MD, we were taught dogs running loose unattended in the woods during deer season would most likely be shot. It was the one time of the year you didn't take dogs into the woods.

The law will be on the side of the hunter when court comes around. Leash laws are there for a reason, keep your pets under control and they will not be killed.
There are plenty of people that will control your pet if you don't take the responsibility of keeping it under control.
Would some feel different if this dog had bit or mauled a child or two ??
It doesn't matter how the dog got free, it was running loose and it should not have been.

He shot the dog on Maryland park property, isn't that illegal? The dog was wearing a collar and tag, clearly not a stray. I think this guy just wanted to kill something, didn't matter if it was a dog, deer or what ever.

Even if he thought it was a stray and shot it as he says for the "good of the community" I'm at a loss for why he slit its throat. That's just barbaric. This guy definitely has a screw loose.

You're an idiot. Animals get loose sometimes, it's part of life. People need to think before they act. Don't see anywhere where it states the shooter feared he was in danger.

The whole area had that problem. There was an 8 year old over here, I think it was near Huntingtown, who was mauled and killed by a pack when he was riding his bike. That was 18 or 20 years ago. South County also had problems.

We were taught that in Western PA, too. At that time (40+ years ago) you could legally shoot a dog running deer. That was any time of the year.
