Ninth Circuit Court Now Demands It Be Protected From Itself…


Additionally, the full ninth are asking the Trump administration to file an additional brief telling the court why the three member original appeals ruling authority was wrong. In essence, the smart judges know what wasn’t considered, and are now looking for an out.

You just can’t make this stuff up.




Wait, wha… huh? Yes, that’s the 9th circuit requesting its own judicial membership ruling to be reviewed by the entire larger 9th circuit appeals court panel. Ya think maybe they recognize they just jumped head-first into showcasing their own insufferable moonbattery…

On Friday, Jay Seculow, who has argued around 12 cases before the SCOTUS during the past three decades, and has a 75% win rate (9-3), said this entire matter can be cleaned up in a new, one paragraph EO from the trumpster, simply meeting the demands of the 9th. That would remove any doubt, enacting most of the first EO, and the 9th would be forced to affirm it.

That is not what the 9th Circuit was asked to rule on. They were only asked to rule if the stay should be kept in place until the judge who ordered the stay had time to hear arguments and make a decision on the merits of the case. The 9th was not asked to determine merit.

Everyone who is actually paying attention to this knows that all Mr. Trump has to do, or had to do initially, was write a proper order. But he didn't and his ego likely won't allow him to do so now. Re-writing the order will be a political loss to him and a victory for the majority of people who oppose him. A rewrite will just be more proof that Mr. Trump and his staff aren't qualified for the jobs they hold. Instead of doing what is right to accomplish his goal he will continue to fight a battle that he has only modest chances of winning. Even if he does win, he will have spent significant amounts of political capital on an EO that is only scheduled to last 90 days.

The current order, as written is a mess. Like most of what Mr. Trump has tried to do it was poorly planned, poorly conceived and ever more poorly implemented. Mr. Trump was king of his private business...his word was all that mattered. Mr. Trump has yet to understand that the Presidency is not in any way similar to being the owner of a privately held company. The "Rule of Law" he is so found of spouting about applies to the President just as it applies to the gang banger. Unfortunately, Mr. Trump has surrounded himself with people who refuse or are unable to counsel him on how to be President.

It appears that all Mr. Trump needs now is a refugee to make an ass of himself to destroy the 9th circuit.
Now none of us wants to se that happen, but if it does the 9th. circuit carries the blame.
