IGNORANCE: Democratic Senator Says Gun Silencers Make Guns Silent. They Don't.


Now that Donald Trump is president, and Republicans control both chambers of the legislative branch, hope has been revived for the Hearing Protection Act, a bill designed to make firearm silencers (otherwise known as suppressors) easier to purchase.

As it stands, one can own a silencer, but only at great cost. According to The Washington Post, to obtain a silencer, one must pay a $200 tax, and wait nine months for the approval process.

In 2010, there were 285,087 registered silencers. Last year [2016]: 902,085.

Guns.com corroborates the number, reporting that as of February 2015, there were an estimated 800,000 suppressors in circulation. Some of the most common uses for suppressors include target shooting and hunting.

Nevertheless, Senator Kirsten Gillibrand (D-NY) has come out strong against suppressors, claiming they make guns "quiet" and implying potential mass criminal use:

I'm fighting back against bills (backed by the Trump admin) that'd make it easy for criminals to buy gun silencers.

Can you imagine if we allowed a criminal with a gun in New York City to attach a silencer to their weapon? It'd be a dangerous mistake.

When someone gets shot by a gun with a silencer, it's quiet. Witnesses might not hear. Police will be less likely to track down the shooter.

According to Paul A. Clark, "There are very few cases of the actual use of a silencer in a crime, that is, a firearm discharged with a silencer attached. Of the federal court cases reported in the Lexus/Westlaw database between 1995 and 2005, there are only two cases of a silencer being used in a murder in the United States."

Hey, that's an intelligent thought...let's take it a step farther shall we...there haven't been any cases of US citizens being murdered by a dirty bomb either...maybe we should make those legal too? Every drunk redneck on St George's island needs his own dirty bomb!! Those gangbangers from Chicago might invade his house to steal his stack of "vintage" Playboys and his emergency case of PBR.

Silencers/suppressors are quiote easy, and legal to obtain. Just follow the rules and pay your money, and make that gun just shut up.

The Basic steps to obtain a silencer are listed below: • Make sure you can own one in your state • Pick a silencer to buy • Find a Class 3 Dealer • Fill out and complete the required paperwork IN DUPLICATE • If an individual, obtain Law Enforcement signature on the forms be fingerprinted and paste or tape two photographs of yourself onto the forms • If a Corporation or Trust, you may skip the above step • Pay the $200 Transfer Tax to BATFE • Wait for your paperwork to clear • Fill out a ATF Form 4473 • Take your silencer home

The first three steps have been covered so far and we will now go over the paperwork part of the process. Here is exactly what you will need:

• Two (2) ATF FORM 4’s (ATF FORM 5320.4) • Two (2) ATF FORM 5330.20’s Certification of Compliance with 18 U.S.C 922(g)(5)(B) called “Citizen Certification” Forms • Two (2) FBI Fingerprint Cards (FBI-258LE) • If corporate or a trust you will need to send ATF something to show them the entity is active and current. Often, a certificate of good standing (available from most Secretary of State websites for a price) is required. No fingerprint cards are required for corporate/trust applicants.

Those steps regarding the trust have changed in the last year. Even if you have a trust now, you have to get fingerprinted and submit pictures. In fact, now, everyone in the trust needs to submit fingerprints and pictures. You no longer need to have a Law Enforcement signature, but you need to inform them of your purchase. How you do that I have no idea since I haven't bought anything since the trust laws changed.
