This could have deep implications. Claims that this was officer Herk are unsubstantiated.

Police and prosecutors in Baltimore have launched investigations after being alerted to body camera footage that the public defender’s office says shows an officer planting drugs. One officer has been suspended and two others have been placed on administrative duty, police said. Police said they have not reached any conclusions as to the conduct depicted in the video. Other cases in which the officers are involved are now under review as well, police and prosecutors said.
The public defender’s office, which released the footage, said it was recorded by an officer during a drug arrest in January. It shows the officer placing a soup can, which holds a plastic bag, into a trash-strewn lot.

Their defense was they were recreating what went down during the drug arrest.

It's unfortunate because now every case they've worked is questionable now.

It's unfortunate because now every case they've worked is questionable now.

The State’s Attorney announced they reviewed more than 100 cases and ultimately had to drop 34 cases which had felony drug and handgun charges attached to them.

It's worth noting that all this came about the the video came out not because a good cop was looking out for his profession or because a citizen got it via FOIA requests, but because someone at the public defender's officer saw the tape and flagged it for the prosecutors office. The same office that, after getting the video, used the officer in question to testify in another case (and didn;t tell the defense team).

Imagine if this was in PA or NC, where lawmakers claim these recordings are not public record and exempt from FOIA laws.

Regardless, an innocent man who couldn't afford bail sat in jail from January to July even though the prosecutor's office got the video in April.
