California Man Has Home Raided, Guns Confiscated After Trying to Register Firearm

Jeffrey Scott Kirschenmann attempted to register an AR-15 with the California Department of Justice last month but instead found himself in significant legal trouble. The California DOJ accused Kirschenmann of illegally modifying the rifle he attempted to register. Law enforcement officials raided his home in Bakersfield before ultimately confiscating a dozen firearms and a few hundred rounds of ammunition, then charging him with a dozen felonies, KGET reports. Kirschenmann was accused of possession of assault weapons, two silencers, and something referred to as a "multi-burst trigger activator." He does not appear to have been charged with any violent crimes.

The issues stem from a new California gun law, one of the strictest in the country, which redefined an "assault weapon" and required anyone with a gun that fell under the new definition to register it with the state. Joe Pilkington, a court-recognized firearms expert, told the news station that California's continually changing gun laws can be very difficult to navigate without professional help.

"Just in the last few years, there have been lots of changes in gun laws," Pilkington told KGET. "Making an effort, a good faith effort to comply with these really complicated laws, should count for something. There is this self-registration application on the Department of Justice website, but it may be better to talk to an FFL [Federal Firearms License holder]. Someone who has a license, to talk through whatever these complications are."

The National Rifle Association said Kirschenmann's ordeal is proof that even those who attempt to comply with California's gun laws can still get caught up in them.

I dont get it, an otherwise upstanding citizen reports his firearms as required. If he knew he wasnt in compliance, he obviously wouldnt have posted them. Why couldnt this be handled with an "assist visit".

"Howdy Sir, I'm LT Dan from the County Sheriffs office, and we are here to talk about the firearms you reported., Now, nothing to be alarmed with, we think that maybe you have some unwitting violations and we're here to talk to you about coming into compliance."

Same way the health department treats businesses. You bring them into compliance.

Ill wait to see how he altered the firearm before i draw any conclusions. This is a great example of "you better know the law if you are going to own guns in a state like california or MD".

In California, "Illegal alterations" or illegal features include a pistol or thumbhole grip, telescopic stock, standard mag release, forward grip, suppressor, etc..stuff AR-15s everywhere else always have at least one of. Many have all of the above.

I have to wonder what was in the picture that lead them to conclude the rifle was "illegally modified" as opposed to simply exhibiting a feature or features common to all other AR-15s.

And only 230 rounds of ammunition???..what a joke.

so what? he is in california therefore the laws of california are what he needs to abide by. That is how it works.

That's why our Navy son's AR-15 is sitting in our safe while he's stationed in San Diego. Just wasn't worth the hassle and potentially jeopardizing his officer career. He'll pick it up when they transfer, probably back to a flying command@ Jacksonville, later this year.

:yay: The crazy stuff that has to be done to make an AR "cali compliant" makes the rifle quite silly looking and damned near useless anyway. Which was obviously their intent.

My son shoots high power whenever he gets the chance, it will be interesting to see where his first duty station will be, and what hoops he has to go through to keep his AR in the armory where he's stationed, if there is somewhere close for him to shoot.
