A federal judge struck down the Affordable Care Act, ruling that its mandate requiring people to buy health insurance was unconstitutional.

The ruling was on a lawsuit filed this year by a group of Republican governors and state attorneys general. A group of intervening states led by Democrats promised to appeal the decision, which will most likely not have any immediate effect.

But it will almost certainly make its way to the Supreme Court, threatening the survival of the landmark health law and, with it, health coverage for millions of Americans, protections for people with pre-existing conditions and much more.

"On November 6, the American people overwhelmingly rejected Republican efforts to raise health care costs and kick millions of Americans with pre-existing health conditions off their insurance coverage. Republicans were sharply rebuked by the millions who value the Affordable Care Act's guarantee that getting sick or having once been sick should not mean a lifetime of higher premiums or being denied coverage. Having failed to repeal the Affordable Care Act in Congress and having failed to win a mandate for their dangerous agenda at the polls, President Trump and his Republican allies are trying to use the courts to do so. Today's ruling represents their latest effort in this onslaught against Americans' access to quality, affordable health coverage. If this ruling is allowed to stand, it will be dangerous to the health and wellbeing of millions of Americans.

“When the new Democratic Majority assumes control of the House, one of our first priorities in January will be protecting those with pre-existing conditions and stopping Trump Administration and Republican efforts to kick them off their coverage or cause their health care premiums to skyrocket. This is what the American people elected us to do, and we will use our new Majority to meet that responsibility."

The theory, if we are to believe it, is that if everyone in the USA gets an Un-affordable Care policy, there will be some much money coming in from the ones who actually pay for their policy that everyone's rates will go down. There are several problems with their theory:

1) As the judge ruled, it is unconstitutional to force a citizen to buy something from a private company. They tried a slick willie by imposing an income tax penalty -- administered by the IRS -- for those who didn't get a policy. Taxes aren't unconstitutional, or so they tell us.

2) Several years after the enactment of this criminal legislation, everyone's rate have risen substantially, especially the poor bastards in the so-called individual market where most small business owners find themselves. The cheapest policy was running around $800/mo with a $6500 annual deductible. And let us not forget, that the government is subsidizing the private insurance companies with billions of taxpayer dollars, and the premiums are STILL this high.

3) There is little to no competition in the so-called marketplace. If you live in St. Mary's Co., there is ONE insurer (CareFirst) for individuals. If you're lucky enough to live in Charles, you get the choice of 2....woo hoo!

4) The DemocRATS have done absolutely nothing to address the shortage of medical professionals. There is ONE urologist to serve all of St. Mary's Co., and he's no youngster!

5) The DemocRATS have done absolutely nothing to address the high cost of medical care. Much of this is caused by the lack of aforementioned competition. The drug industry also engages in "what the market will bear" pricing, even though, in many cases, the majority of the development cost for the drugs was paid for by the tax payers.

6) The business model for the health industry is still in the dinosaur age. It is virtually impossible to shop for medical services or prices.

7) People think health insurance should pay for everything down to their condoms, band aids and aspirin. Compare this to the auto insurance industry. They pay to repair things when there has been an accident. They don't pay for oil changes, car washes and new floor mats. If people paid for their own day to day health needs and used insurance for major medical needs, prices for health care and insurance would go way down and the ability to shop for prices would appear. Maybe someone would eventually even Amazon.com-ify the whole freaking mess.

All you hear from ####-tards like Steny Hoyer is how the evil Republicans (and yes there are many) are trying to hurt us Americans with pre-existing conditions. Yes, there is definitely a major issue there to be solved, but the Charlie Foxtrot that Hoyer and his fellow sociopaths have created certainly appears to not be the answer.

If anyone cares to defend ObamaCare, I ask only one thing. Before you say anything else, state for the record how much your total monthly premiums are and then how much of that you actually pay out of your own pocket. My guess is that for most defenders, someone else is paying the vast majority of the premiums, if not all.

This is my biggest concern with all of this. I have family with some pretty significant pre existing conditions. What happens to them once ACA disappears? (Please dont take that as support for Obamacare, I dont support it as a whole but have seen where some have benefitted from it).

You don't have a job that provides health insurance?

Wasnt speaking of immediate family. My concern is for a nephew who is reaching the age where he will no longer be on his parent’s insurance.

That makes him mid 20's, does his preexisting condition prevent him from having a job that provides insurance? If it does then he is covered by probably more than one government program, I have a 2nd or 3rd cousin that is a ward of the state for that very reason.

I'm surprised it took this long for them to overturn it. Clearly it was forced on the American people under penalty if they didn't buy into the ponzi scheme. I doubt insurance premiums & deductibles will revert back to pre obamacare levels. But they should.

My son was penalized because he was on my wife's policy when she passed and he hadn't been employed long enough to get picked up by his employer. The IRS should refund his "penalty", but I'm sure that's a pipedream.

I am sorry for the loss of your wife. :huggy: And, I am sorry that socialist communists are trying to destroy our wonderful country.
