U.S. says no one too young for Guantanamo court

"GUANTANAMO BAY U.S. NAVAL BASE, Cuba (Reuters) - A Canadian accused of killing a U.S. soldier in Afghanistan should not be tried as a war criminal because he was a child soldier for al Qaeda, too young to voluntarily join its forces, his military defense lawyer told a U.S. war court on Monday.

Navy Lt. William Kuebler asked a military judge to throw out the charges against Canadian defendant Omar Khadr, who was shot and captured at age 15 in a firefight at a suspected al Qaeda compound in Afghanistan in 2002.

"He is a victim of al Qaeda, not a member of al Qaeda," Kuebler said."

I agree with DoJ.

Think of it this way: if he were a young American kid who threw a grenade, planted bombs in US streets and killed people, he would likely be tried as an adult, regardless of whether he ran with a gang or not.

So too bad.

Old enough to commit an adult crime, old enough to face an adult penalty.

This should be standard throughout the justice system. Adult crimes like murder, rape, etc. should always be prosecuted in the adult system.

This case is controversial

Under Taliban rule, he had no choice but to join al-Qaida.

But

He DID shoot a U.S. soldier when he could've surrendered peacefully.

Yesterday, in these very forums I read about a 15 year old lad who murdered his Father Mother and Sister. Are they any less dead than if he had been 21, or 41? I dont think so. He will be tried as an adult.

Now this young fellow , judging by his name was brought up in an Islamic family in Canada. It appears obvious that he was taught to hate anything not Islamic, he went to Afghanistan from Canada ,quite obviously to join in battle with American troops.
Although I am sorry he is in Guantanomo, (he should have been killed right there in Afghanistan), I certainly dont feel that he should receive any benefits from the fact he is young. Could the soldiers he was fighting against notice any difference in the grenade he threw or the IED's he planted? is the soldier he killed any less dead?

Now if this boy had grown up in Afghanistan I could see a little more how he could be coerced by Al Qaeda into joining them, but he went from Canada to Afghanistan to join this fight. Check back with me in 25 years after this young man has had a little time to think it over, and maybe then mercy will be easier to give.

I agree, let him go, just tattoo and American Flag on his forearm and set him free back in Afghanistan...:whistle:
