SCOTUS Justice Restores President Trump's Travel Ban



Supreme Court Justice Anthony Kennedy has issued a temporary order blocking a 9th Circuit Court of Appeals decision that would have limited President Trump's travel ban.

The "administrative stay" issued by Kennedy on Monday puts on hold the ruling from the liberal federal appeals court which said the ban wouldn't cover refugees working with U.S. refugee agencies and other refugees "covered by a formal assurance."

The ruling allows the Trump administration "to exclude most refugees from entering the United States while the Supreme Court considers challenges to its revised travel ban," The New York Times wrote.

What does it say about these "judges" when the Supreme Court has to slap them down?

It generally DOESN'T inspire me much about the courts and the law if it can be contorted to mean whatever a judge wants it to mean.

Even SCOTUS can render horrible decisions.

Actually I was reading something about THIS - the other day. That we have three branches of government, but that we tend to somehow revere the SCOTUS so much that when they render a decision -
we somehow give it the force of dogma. You know, truth, once and for all. And that's not why the other two are there. The other two are a check and balance on SCOTUS as well.
Why is that - why do we think that if SCOTUS decides something, well then, it's a done deal? Can't be messed with?

The better question is, "What does it say about us"? We elect these judges on local and state levels, and we elect the congresses and presidents that select such judges and those that approve them into office. It's on the collective "us".

It shouldn't be to slap down activist judges. IMO if a judge gets overturned more than once, he should be removed from the bench.

Not to mention Antifa. I wasn't aware until a few days ago that those crazies are rich kids that are attending liberal higher education institutions. What are they thinking? They are not thinking, and have no clue. That is the problem.

I won't say the judges in this particular case ruled in a particular way based on thie political beliefs, but SCOTUS exists, one one sense, because lower courts reach a contradiction point. Just about every SCOTUS decision makes lower judges' rulings moot. That doesn't mean that they are "activist judges".

It's worth noting, SCOTUS hasn't ruled on anything yet. Just issued a stay.

In victory for Trump, Supreme Court dismisses travel ban case

WASHINGTON — The Supreme Court dismissed a major challenge to President Trump's travel ban on majority-Muslim countries Tuesday because it has been replaced by a new version, sending the controversy back to the starting block.

The ruling is a victory for the Trump administration, which had asked the court to drop the case after Trump signed a proclamation Sept. 24 that replaced the temporary travel ban on six nations with a new, indefinite ban affecting eight countries. That action made the court challenge moot, the justices ruled.

"We express no view on the merits," the justices said in a one-page order.

The decision effectively wipes the record clean in the U.S. Court of Appeals for the 4th Circuit, one of two federal appeals courts that had struck down major portions of Trump's travel ban. That case began in Maryland.

A separate case from the 9th Circuit, based in California, remains pending because it includes a ban on refugees worldwide that won't expire until later this month. But the Supreme Court is likely to ditch that case, which began in Hawaii, as well.

"In a one-page order, the court acted in one of two cases pending before the nine justices over Trump’s travel ban, a case from Maryland brought by the American Civil Liberties Union, which sued to stop the ban contained in a March executive order," Reuters reported.

The justices were unanimous in deciding against ruling in the Maryland case, although one of the liberal justices, Sonia Sotomayor, noted that she would not have wiped out the appeals court ruling.

The justices had been scheduled to hear arguments in the case on Tuesday, but removed it from their calendar after Trump’s 90-day ban expired on Sept. 24 and was replaced with a reworked ban.

The expired ban had targeted people from Iran, Libya, Syria, Yemen, Somalia and Sudan. The new open-ended ban, scheduled to take effect on Oct. 18, removed Sudan from the list while blocking people from Chad and North Korea and certain government officials from Venezuela from entering the United States.
