If you’re a gun-owning Pennsylvania resident, the Pennsylvania State Police are urging you to turn in your firearms if you are seeking medical marijuana cards.

Sorry, what?

A statement from the Pennsylvania State Police’s website is receiving a lot of local attention over what appears to be an erroneous statement concerning state and federal law.

The statement reads:

“It is unlawful for you to keep possession of any firearms which you owned or had in your possession prior to obtaining a medical marijuana card, and you should consult an attorney about the best way to dispose of your firearms.”

Here’s the catch

According to Pennsylvania state law, the use of medical marijuana is legal, and not a hindrance to owning a firearm. However, according to the state police website, Pennsylvania’s legalization of medical marijuana is not federally recognized.

According to 18 U.S.C. § 922(g)(3) and 27 C.F.R. § 478.32(a)(3), possession of a medical marijuana card and the use of medical marijuana determines that a citizen is an “unlawful user of or addicted to any controlled substance.”

Federal law prohibits an “unlawful user of or addicted to any controlled substance” from purchasing, acquiring, or possessing a firearm.

In short, federal law says it is illegal for a citizen to attempt the purchase of a firearm if they are a medical marijuana cardholder.

This isn’t new information: the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) has held the position since 2011 that no one in possession of a medical marijuana card may also legally own a firearm.

Generally speaking, state police cannot enforce federal law unless a statute gives them express permission to do so. Pennsylvania law is somewhat ambiguous on this point, allowing the PSP make arrests “for all violations of the law,” without specifying whether this includes federal law.

I don't understand. The folks that claim marijuana is a cure all for all ills also say that it isn't habit forming, and doesn't make you any more intoxicated than alcohol'.
Now the States making it legal obviously think the same thing.
So why take away a person's right to own guns for using it.

How about Oxycontin and other prescribed drugs.
Looks like a backdoor confiscation scheme to me.

There's lots of opinions about weed but not alot of facts..
Like the new hype with weed oil, nothing but opinions in all the advertisements but no facts..
What I find interesting is a few States have forgotten about due process with removing citizens given Rights. This year is going to be interesting with guns and weed for sure.

I have been fighting a cold for 3 weeks now. I went to urgent care and waited a couple of hours with others there coughing and sniffing and blowing snot, we all had pretty much the same symptoms. After i saw the Doctor I told him if he would just leave some prescriptions for Amoxycillin at the desk and pass them out he could save him and his patients a lot of time.

I wouldn't be too worried about dopers with firearms. They couldn't shoot very accurately while giggling and spittin'.

Except that they could be meaning to shoot your buddy 10 feet away and get you instead. That would not be that big an issue, right?

Ok. Just to clear this up. Heroin, synthesized from morphine, is illegal. Morphine and opium, both derived from the seedpod of the poppy plant, which derive codeine, hydrocodone (Vicodin), oxycodone, oxymorphone, hydromorphone, all from one plant are legal as long as you have a prescription. All these are true opioids on the list of controlled substances. Illegal on their own without prescription. Still ok to buy and own a firearm as long as you are "prescribed". Yet, cannabis, that of which is now being "legally prescribed", which has been proven, absent of course the blessing of US gov't and official US gov't sanctioned medical reports and testing [sarcasm], as safe after hundreds of years of use, will prevent you from buying or owning a firearm? Okey dokey.

It is all about the Schedule I designation, though the majority of the States (to some extent) allow their medical professionals to prescribe it as a medication, the Federal law says it has no medicinal value.

Two different groups at play here with two different agendas. The people who voted for legalizing marijuana were the populace of the state. The ones wanting to take away the guns are the state police. I'm sure if the police could find a way of adding "are you an alcoholic" to the list of disqualifiers they would.
