The Maryland state senate just fired a broadside at President Trump in terms of his hopes for reelection… or so they think. Like many other blue states, the Old Line State’s upper chamber just approved a new bill which would require all presidential and vice presidential candidates to submit five years worth of tax returns in order to make it onto the ballot. Yes, it’s a grand day for democracy, isn’t it? But the measure in question didn’t even draw the support of all the Democrats in the chamber. (Baltimore Sun)

As has been repeatedly documented in the past, the states are not allowed to impose any sort of restrictions to ballot access which would go beyond the qualifications for the office set forth in the Constitution. The Supreme Court has already weighed in on that question when term limits were being discussed. Exceptions are made for minor requirements such as gathering a specific number of signatures to prevent the ballot from becoming flooded with candidates with zero viability and the requirement for filing fees, but that’s about it.

Even California Governor Jerry Brown, generally regarded as the de facto king of the #RESIST movement, vetoed a bill like this last year, saying that the courts would have just overturned it anyway. And when you’ve lost Jerry Brown…

This reminds me a little bit of the "birth certificate" issue Arizona passed and their governor vetoed. That one, at least, was asking for proof of an actual constitutional requirement to be president.

Well, MD isn't important to Trump's reelection bid since MD's Electoral votes would most like go for the Dem anyway.

Maryland desperately needs to get rid of the Democrat lock on our legislative branch.

Ah, but to not even be on the ballot? AZ wasn't really a big Obama state, either. But, I'm sure he still wanted to be on the ballot. So, if that bill would have become law he would have had to produce a birth certificate in an official way. That would have been a challenge to him if he actually was not born in HI as he claimed. (I am not suggesting he was or was not born in HI, I'm talking about the thought process behind making that bill a law.)

This is similar in that Trump would either have to say, "fa-q, Maryland" and not be on the ballot, or, he would have to provide the heavily-sought tax returns. It would appear he is really not interested in providing personal documents that he does not need to provide, and certainly no candidate for president would like to officially, openly write off a state.

Obama could not have given a Birth Certificate. One wasn't forged for years after he became President.

What would be cool is if the MD legislature fascists get this passed somehow, and Trump says, eh, and chooses not to be on the MD ballot. Then MD Republicans come out hard for a third party, who wins the state, and takes those electoral votes away from whatever Socialist puppet the Dems prop up.

I think even if not on the ballot, Reps could write-in Trump. Perfectly legal.

Actually, while MD is usually a good bet for Dems, it doesn't ALWAYS go Dem. Since WW II, MD has gone for Thomas Dewey 48, Dwight Eisenhower 52 & 56, Richard Nixon 72, Ronald Reagan 84, and George H W Bush 88.
