New York's attorney general says Trump's company misled banks, tax officials


The Trump Organization, it said, had overstated the value of land donations made in New York and California on paperwork submitted to the IRS to justify several million dollars in tax deductions.

The company misreported the size of Trump's Manhattan penthouse, saying it was nearly three times its actual size — a difference in value of about $200 million, James' office said, citing deposition testimony from Trump's longtime financial chief Allen Weisselberg, who was charged last year with tax fraud in a parallel criminal investigation.

James' office detailed its findings in a court motion seeking to force Trump, his daughter Ivanka Trump and his son Donald Trump Jr. to comply with subpoenas seeking their testimony.

Investigators, the court papers said, had "developed significant additional evidence indicating that the Trump Organization used fraudulent or misleading asset valuations to obtain a host of economic benefits, including loans, insurance coverage, and tax deductions."

New York Attorney General Letitia James has taken legal action to force former President Donald Trump, Donald Trump, Jr. and Ivanka Trump to cooperate with her investigation into the Trump Organization’s financial dealings.

James on Tuesday filed a motion seeking a court order to compel the three family members to appear for sworn testimony as required by subpoenas that have been issued to the Trumps by her office.

According to the investigation, what was disclosed on the statements, which are used by the outside companies to determine Trump’s financial condition, differed from the information the Trump Organization sent to its accountants.

“The OAG has determined that the statements … described Mr. Trump’s (or the Trustees of the Revocable Trust’s) valuation process in broad terms and in ways which were often inaccurate or misleading,” the AG’s office said, “when compared with the supporting data and documentation that the Trump Organization submitted to its accounting firm.”

Some of the alleged misrepresentations on the financial papers, according to James’ office, include overstating the size of the former president’s Trump Tower penthouse and a failure to use fundamental techniques of valuation.

The inflated assets also allegedly helped Trump’s liquidity by wrongly categorizing assets outside the Trump Organization’s control as “cash.”

The AG’s office said numerous allegedly misvalued properties owned by Trump and the Trump Organization were frequently included in the statements to obtain loans.

In case there was any danger of Trump fading out of the headlines, they’ve sued him, again. Yesterday, ABC ran a story headlined, “New York AG Letitia James Files $250M Lawsuit Against Trump for Defrauding Lenders, Others.”

This latest lawsuit is a civil case, filed by New York Attorney General Letitia James in state court, against Trump and his family members, for “numerous acts of fraud and misrepresentations.” It’s a 222-page blockbuster.

Here’s another one of my counter-intuitive rules about lawsuits. The longer the complaint, the less likely it is to have any merit, and the more likely it was to have been drafted by immature attorneys.

If it takes 222 pages to explain why what the person did was wrong, that’s not a good sign. The technical term for this is “over pleading,” and it is actually a rookie strategic mistake, because the more stuff you jam in the allegations, the more material you give the defendant to work with in a motion to dismiss.

I skimmed it. It was a waste of time. Letitia has been running a criminal investigation against Trump for years now and, instead of filing criminal charges, she filed this civil case instead, suggesting that she couldn’t come up with any criminal charges that would stick. I predict this one isn’t going anywhere either. It’s just a distraction.
