Do you think, regardless of what the laws are, that a 17 year old who has consensual sex with a 15 year old is a "child molestor"?

Yes or No.

Pete? You're the one that says the law is the law - surely then, you think this is a clear case of child molestation? Considering that's what he was convicted of?

I believe it is in the best interest of the state to protect children from destructive behavior. I believe that sometimes it sucks. I believe sometimes they capture true criminals.

No I don't think Wilson is a child molester and I said a bazillion times 10 years was too much. In the absence of a better solution he should have taken the plea deal because he did break the law as written. As it is he won on appeal and the loop hole in the law was closed.

The plea deal wasn't an option. By taking it he wouldn't have been able to live in the same house as his little sister.

Yes, only as it pertains to the punishment. I think he should have consequences for a sexual act with a 15 year old since the age of consent is 16. Fine, probation would work for me. I feel it should be applied to the chick too.

You know part of the thing about being an adult is making choices. He screwed up by engaging in a sex act with a 15 year old. Now he had to choose between "I have to sit in jail for 10 years" or " I can get out and live with someone else and fight to get my name off the predators list." Not a hard choice to me.

That's exactly right. The only way ignorant laws get changed is when someone makes a stink about them instead of just letting the idiot tyrants have their way.

I'm sorry this kid got caught up in the system, but that was a stupid law and the good outcome is that it's now changed. :yay:

Very true but laws do get changed all the time when it is pointed out there is a glitch.

Anyway, Wilson would still be guilty of a crime under the new law, it would be a misdemeanor though.

I am beyond stunned that though it was recognized by most that an injustice was done to him and that he could have been out earlier... the attorney general aggressively and willfully continued to fight to keep him in...:burning:

Wilson was ordered released. He was re-sentenced to 12 months in prison, a total victory for Wilson, who has served nearly double that already. Furthermore, he does not have to register as a sex offender when he gets out. But the prison doors have not sprung open for Wilson. The attorney general has filed an appeal, seeking a higher court's ruling as to whether the court has the power to commute Wilson's sentence to a sentence that did not statutorily exist at the time of his conviction.

Wilson's lawyer, B.J. Bernstein, is asking the court to set an appellate bond which would permit Wilson's release pending appeal. Hopefully, it will be a bond that Wilson can afford to post.

Bernstein is extremely disturbed that the attorney general would continue to fight to keep Wilson behind bars.

Initially I was too but you have to look at "big Picture". In trying to free this 1 person how many of the thousands of other sexual offenders in prison could apply and may receive relief based on this retroactive decision? In freeing Wilson, how many true criminal molesters could be released because of that precedent?

Yep, everyone wants to climb on the "Feel Good " band wagon but then when Chester the Real Molester uses that precedent to get out of jail along with a couple hundred others no one wants to hold that potato.
 
I disagree with you, Pete... the change in law pulled him out of the criminal felony masses and put him in the teen sex "misdemeanor" category where he belongs... I don't see any sexual felony criminals benefitting from this at all...
