So here's the deal- my dumb father, who owns his own business, failed to file tax returns for about 3 years. Those tax returns equalled owing about 100K. The IRS has just begun persuing action against him with letters and asking him to itemize what he owns in his house and so on.

So, he doesn't have the tons of money he now owes. The IRS sounded willing to work through payments, but he is in a situation where that will be minimal at best. So, anybody who has worked for the IRS or a lawyer know what a "typical" outcome of this scenario would be? I'm so po'd about this and his stupidity. Unfortunately, my mother relied too much on him and ASSUMED he paid their taxes. Now she is heartbroken and, of course, worried about her future.

What are the odds of jail time? Anybody know?? I can't believe I'm related to this guy. :smack: (oh, they live in Florida, if that matters)

Other people's fathers do this too? I thought I was alone in the world. The IRS started calling ME to get in touch with my father, can you believe that?

I wish I had some advice, but whenever I try and talk to my dad about it he gets all pissed off at me.

Its a lose-lose situation for me. Good luck to you.

Yeah, my next question is "is debt inherited". :lmao: My parents will pass away one day. What happens to all of their debt? It surely doesn't go to their kids, does it? I can't imagine that it could, but it DID cross my mind.

No, but if he socked money away for you, don't expect to see it until the IRS is satisfied taking its share.

I like your style- short and to the point. :lmao:

Is this a guess or based on something you've seen?

Honestly, I think that if he contacts the IRS and sets up a payment plan that he can live with ~ not one that a child can pay, they'll be willing to go 4 or 5 years, I bet, for that amount of money. The key is, he has to pay it and on time until it is paid in full. I think that if he misses one or he is postmarked late, he's in the doghouse. I could call the person I know that had dealt with this, but it's too late at present.

That is what I am hoping. He gave them 10K (everything he had) immediately to show them that he was willing to try and make it right as much as he was capable of. I'm hoping that shows some initiative to set up a plan to pay what he realistically can, give him a shot to pay it, and go from there.

I'm just not sure what the possibilities of jail are for him. I'd like to think the IRS would realize that he is of no value to them in jail and would be better served working and paying for his taxes. BUT, it's not like he doesn't deserve to go to jail. I'd want to send his butt there too.

He honestly must not have filed as he knew he owed an amount larger than he had available to pay at the time. My ex did the same crap we spli tup in "03" and the other day he tells me he has not filed since then and now they are coming after him. I was like well that was not a smart thing to do.

So my question is what can the IRS do to a man with no job, car, home or other asset to levy? Can you get locked up for not filing?

Are you my long lost sister? lol j/k I've been thinking the same thing. Everyone I talk to said no, it doesn't get inherited.

I know my dad hasn't saved anything either, he set up a payment plan like 3 years ago, and I'm sure he's not stuck to that.

My uncle who is a sheriff's deputy back home said worst case if he goes long enough they can lock him up for tax evasion, but he's not sure what kind of sentance he would get.

Also there will be liens against the property if they already dont own it unfortunately:jameo: Get a good lawyer, ive seen commercials all the time where the client only had to pay a fraction of what they owed.
