Apartment Carpet

Does anyone know if there is any law in MD that requires your landlord to replace the carpet in your apartment after a period of time? The carpet was worn when I moved in and I have live there a tad bit less that two years so I am estimating that the carpet has been in for over four years.

I really doubt there is a law, but it sure would be nice if that was true. Have you tried asking your LL to get new carpet?

I so had to laugh at that. It took over six months for them to replace my dishwasher after four different maint. men couldn't fix it. My outside water faucet just got fixed after several months. They have switched management companies three times just since I have lived here. Everytime I make a complaint I have to give them a copy of my original security deposit because they can't keep track. That is why I was hoping there was a law or something because I know it is a lost cause!

That sux! My LL is awesome. If I call him about something he usually fixes or replaces it within 48 hours.

Have you thought about moving. Your land lord sounds worthless, I would kick him in the balls so hard that everytime they itched, he would have to scratch his throat.

there is no law in maryland that requires the carpet be up to a certain standard in rental units.

now, maybe, and this is a long shot, if the wear is to the point that it is worn through and people are tripping on it,, maybe something could be done.

if you force them to replace it, expect them to claim it is worn by your fault and try to get the money back out of you.

If the carpet is 6 to 10 years old they cannot recoupe the cost of replacement through the tenant.

My lease is up in November but I hate moving--and around the holidays is even worse. I think I will renew my lease IF they will replace it. Perhaps the third management company is the charm. lol

But if it is replaced early can't they only claim depreciation for the time I had it?

I don't think there is any law stating that the landlord has to replace the carpet if it is worn. If you don't like the appearance of the carpet get some throw rugs to cover the worn spots.

Thought about it...but runners for the steps are pretty costly. I don't want to spend alot knowing that I will be moving within a year.

No law stating that the carpet has to be replaced. Also, you moved in the apartment in an "as is" lease. Unless it is unhealthy (mold and/or mildew), it is not likely that the landlord will replace it. If you move, make sure that the carpet is new in the apartment. If not, ask ifor t to be replaced. If they will not replace it before you move in, then find another apartment.
It's kinda like this. If the carpet was in bad condition when you moved in, then you should have asked to have it replaced before you moved it. Since you did not, then you do not have a right to now. It did not bother you two years ago. If it has gotten worse over the past two years it is due to your neglect. :shrug:

I wouldn't really say neglect. The carpet is clean, it is just very worn. Almost threadbare on the steps. Either way, I talked to the new property manager and he reviewed my files. Since I have been a on time paying resident with no lease infractions they will be replacing it next month at no cost to me. He explained to me that at this point, with the past management companies doing nothing for resident complaints, they have been instructed to keep people happy. He came out today and looked over the carpet himself and can see where the holes are getting ready to form.
