Tech Company On Biden Vaccine Mandate: We ‘Resisted Vaccine Requirements,’ But ‘Must Now Comply’


“As you know, we have strongly encouraged COVID-19 vaccinations since they became available but have equally resisted vaccine requirements,” the email stated. “Based on government regulations, our status as a federal contractor and our support of our customers — many of which are also federal contractors — we must now comply with presidential orders to require vaccines within Lumen.”

“We have tried to avoid this action and preferred to encourage voluntary vaccination, but the rules and regulations are clear, and complying is the only business decision we can make,” the email continued.

After encouraging employees to continue reading with an open mind before making any job decision, and noting that the company greatly values its employees, Lumen stated that the only possible exceptions to the mandate would be “a sincerely held religious belief or medical condition.”

Federal contractors get broad flexibility to enforce Covid vaccine rules for millions of workers

Federal contractors will have broad leeway to enforce President Joe Biden’s Covid-19 vaccine mandate, according to new guidance the White House released Monday, laying out details on implementation of the rules.

Under the new guidance, federal contractors from IBM and Boeing to food service providers will have flexibility to determine how they enforce the vaccination requirements for workers who refuse to be vaccinated.

“A covered contractor should determine the appropriate means of enforcement with respect to its employee at a covered contractor workplace who refuses to be vaccinated and has not been provided, or does not have a pending request for, an accommodation,” said the guidelines, which affect millions of workers.

The federal contractor guidelines are stricter than the forthcoming vaccine mandate for businesses with 100 or more employees, which allow for regular testing broadly as an alternative to a vaccine. The Labor Department is still finalizing those rules. Businesses have asked for that mandate to be delayed until after the holiday season over concerns about possible supply chain disruptions.

The Lincoln Project, and their siren, Tokyo Rose Rubin, have held themselves out as principled conservatives. Their principle is pretense. The organization has been anything but principled, what with claiming that Trump’s a secret Russian agent, and worse disinformation, such as he won’t leave if he’s defeated, and will change the law to stay 12 years. We’re talking unhinged here. Their purpose in life is to troll the president and if the lo-fo crowd buys their agitprop, so be it.

Why Biden’s COVID-19 vaccine mandate is unconstitutional


To make matters worse for the president, OSHA has a poor track record using its ETS “fast track” procedure under the Occupational Safety and Health Act of 1970. It has used this power sparingly in the past, and on those occasions its efforts have not stood up in court. Of course, emergencies arise that call for a rapid response, justifying immediate action over the normal, slower procedures. But OSHA is authorized to use this emergency process only under two conditions: The employees must be “exposed to grave danger,” and the emergency standard must be “necessary to protect employees from such danger.”

On “grave danger,” OSHA has two main claims: that a pandemic that has killed more than 740,000 Americans is obviously a grave danger and that the agency has the sole right to decide whether a “grave danger” exists. Both claims are dubious. Because the pandemic has continued for a year and a half it is increasingly difficult to claim that it demands emergency measures. To be sure, the delta variant has disappointed earlier hopes that life was returning to normal. But widespread vaccination, natural immunity and improved treatments are having a marked effect, and decision-makers are no longer under the pressure of emergency circumstances to decide policy.

OSHA’s second line of defense — that the judiciary cannot review whether a “grave danger” exists — is similarly unconvincing. If the courts blindly defer to the agency, they would give it virtually unbounded power whenever it declares a public-health emergency, no matter how tangentially linked to the workplace. If OSHA had decided that the AIDS epidemic constituted a “grave danger” in the workplace, could it have ordered workers to take weekly tests that identified those who were HIV-positive? OSHA could not have done so free from judicial review.

OSHA is just as unlikely to pass the “necessity” test. Widespread vaccination together with naturally acquired immunity may already be accomplishing what the ETS is purportedly designed to do — protecting more people from getting COVID. And younger workers who are in good health have a low risk of hospitalization or death from COVID. Is the ETS truly “necessary” to protect them? Likewise, is mandatory vaccination (or weekly testing) “necessary” to protect those in the workplace who have already recovered from infection?

“I’m quite confident that when this finally gets fully adjudicated, not just a temporary order, the validity of this requirement will be upheld,” Klain said on NBC’s “Meet the Press” on Sunday. “If OSHA can tell people to wear a hard hat on the job, to be careful around chemicals, it could put in place these simple measures to keep our workers safe.”

Klain may be acting confident, but, as I said in September, Biden’s mandate is a red herring that will inevitably fail to pass constitutional muster in the courts. The Biden administration most certainly knows that the vaccine mandate won’t hold up. They previously recognized their lack of authority to impose a vaccine mandate. White House Press Secretary Jen Psaki said earlier this summer that vaccine mandates are “not the role” of the federal government. “Well, I think the question here — one, that’s not the role of the federal government,” she said on July 23, offering no exception to this assessment. “That is the role that institutions, private-sector entities, and others may take. That certainly is appropriate.”

Klain himself seemed to acknowledge that such a mandate isn’t constitutional when, back in September, he retweeted a tweet that effectively praised Biden’s use of an OSHA rule as a workaround for enacting an unconstitutional federal mandate.

Constitutional scholar Jonathan Turley thinks that will ultimately doom the mandate. “Courts will now be asked to ignore the admission and uphold a self-admitted evasion of constitutional limits,” Turley told Fox News in September. The “problem is that the thing being ‘worked around’ is the Constitution.”

“Klain effectively became a witness for the challengers in labeling the order an evasion or subterfuge designed for the courts. Klain leaves the courts in the unenviable position of ratifying an order that the administration admits is a mere work around to evade constitutional limits. It is akin to claiming self-defense in an assault case while saying that it was the best way to shoot the guy,” Turley added.

Biden Administration Is Considering Whether to Expand Private Employer Vaccine Mandate

According to a summary released by the Occupational Safety and Health Administration, businesses with under 100 employees are being eyed as well.

OSHA is currently “seeking comment” on whether to impose a vaccine mandate on small businesses, too, though it is “less confident” such a mandate will work.

"OSHA is confident that employers with 100 or more employees have the administrative capacity to implement the standard’s requirements promptly, but is less confident that smaller employers can do so without undue disruption," the summary says. "OSHA needs additional time to assess the capacity of smaller employers, and is seeking comment to help the agency make that determination."

A “grave danger” so urgent, don’t you know, that workers need to be protected from it two months from the document’s release and almost four months since Biden’s initial announcement. But only workers at companies that employ more than 100, mind you, because obviously the virus knows not to infect workers at small businesses.

As with all aspects of Covidstan, it’s all a giant farce, of course. Nevermind the fact that most Covid spread happens in households, the workers OSHA are presumably ‘protecting’ aren’t anywhere close to being in any “grave danger” from SARS-CoV-2. In fact, those overwhelmingly at risk from this virus aren’t working at all, but rather are already towards the end of their lifespans. The median age of the US labor force is 42. Of the 160 million people currently working, only ~31,000 in the 40-49 age group have died of or with Covid-19. That’s less than 0.02%, a figure that isn’t anywhere close to being “grave danger.”

And even if this “grave danger” were real, what good would their measures do? The vaccines are close to useless and masking doesn’t do a thing to stop spread. Indeed, it’s difficult to escape the conclusion that this entire garbage mandate is nothing more than a troll on red-state America and the left’s political opponents. The constant testing and workplace masking requirements have nothing to do with health, but rather are meant to be a punishment for disobeying their nonsensical dictates. In the document, OSHA gives lip-service to their measure “protecting” the unvaccinated - who ironically don’t need or want their ‘protection.’

Team Biden’s shady vaccine mandate wordplay


When it comes to President Joe Biden’s vaccine mandate, it looks like the entire administration is descending into dementia.

On Friday, White House Deputy Press Secretary Karine Jean-Pierre insisted that it’s “misinformation” to call it a mandate, since private employers wouldn’t have to fire workers who instead submit to weekly testing: It’s just a “requirement” on workplaces with 100 or more staff. And never mind that Biden himself called it a “mandate” in his speech announcing it two months ago.

Then Surgeon-General Vivek Murthy on Sunday suggested the mandate could expand to cover smaller businesses, insisting that a “vax or no job” rule is a “necessary step to accelerate our pathway out of the pandemic.”

Meanwhile, the courts look unlikely to let it ever take effect: On Saturday, the 5th Circuit Court put a stay on it, expressing clear doubt that the Occupational Safety & Health Administration has the authority to impose it as a “workplace safety” measure.

Biden’s ‘Marxist’ Treasury Nominee Saule Omarova Wants To Bankrupt, ‘Starve’ Fossil Fuel Industry To Tackle Climate Change



“Here what I’m thinking about is primarily the coal and oil and gas industry. A lot of the smaller players in that industry are going to probably go bankrupt in short order, at least we want them to go bankrupt if we want to tackle climate change,” Saule Omarova — who the Senate is considering to lead the Office of the Comptroller of the Currency — remarked in a clip uncovered Tuesday by the American Accountability Foundation (AAF), a conservative research group.

The comments were originally made during a March talk Omarova gave as part of the Jain Family Institute’s “Social Wealth Seminar” series.

Omarova has already been slammed by top GOP senators over her Marxist thesis paper which she has yet to share with the Banking Committee. She wrote the thesis, titled “Karl Marx’s Economic Analysis and the Theory of Revolution,” while studying at Moscow State University in Russia decades ago.

“At the end of the day, these are people’s lives, people are going to lose their jobs because she’s going to support policies that are there to drive them out of work,” AAF Founder Thomas Jones told the Daily Caller News Foundation in an interview.

“It’s people who are not going to be able to send their kids to college, who will not be able to make their mortgage payment because Saule Omarova has a classical Marxist view where she wants the government to run all sectors of the economy and part of that is implementing the Green New Deal,” he continued. “And you can only do that by destroying the oil and gas industry.”
