Biden's Last Minute Pardons

I'm guessing Sleepy Joe (or more precisely, whomever is really running the show) will issue a flurry of pardons in the final days of his administration. Any guesses on who might be a recipient? My guesses in no particular order:

The people that fear legitimate retribution from Trump:
Fauci and Brix
Liz Cheney and all the Jan 6th "Committee".
Garland
Mayorkis
Himself
Jack Smith

And a bunch of low level (i.e., drug possession) convicted people just to give the impression its not purely political.

Maybe a pardon for all illegals? I hope Trump issues pardons and commutes sentences for all Jan 6 defendants.

Joe just dropped the big pardon. Faucci, Milley, and the J6 Committee members.
Let's look at the good side of that pardon. It is an admission they they needed a pardon. They are guilty.
Also it frees up the courts with trials that were not going anywhere and it stops them from saying Trump was looking for vengeance when he went after them. let's just forget about them and go after Schiff full force. There is nothing I would like better than to see that bubble eyed C-sucker go to jail.

Pardons only apply to criminal charges. Start civil lawsuits against all of them to recover the taxpayer funds they wasted. Drive them to bankruptcy in civil court.

Yes, two quick instances are Ford pardoned Nixon (who wasn't charged) and Carter pardoning Vietnam draft dodgers.
The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States; he may require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any Subject relating to the Duties of their respective Offices, and he shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.

While they were not charged based on the above it would appear you cannot be pardoned unless you haved committed an offence against the United States. I am far from a legal scholar so I welcome any explanations.

Obviously what is not included in that clause is that one must be charged with an "offense". The offense could be real, imagined or assumed. And if one accepts such pardon offered it seems likely that the act did happen. If the founders wanted only those charged or convicted with crimes they surely would have stated such. The power is broad with only the one exception (as you noted above).

Another point of contention with pardons is the claim that the power is only for crimes against the Federal law and that belief has only been presumed by the high-court as a limitation on the power and not clearly proven. As such I contend that the power of the Presidential pardon is equally applicable to State laws because it is beyond doubt that the states are what makes us the United States.
