35 in a 50 might be illegal,
however the rules do state that going under the limit is legal if conditions call for it. The woman in question was within her rights to go a few under the limit considering the 40mph wind gusts.

Since the speed limit is set, or is supposed to be set by the 80% rule, it would seem pretty clear that the limit was set at a point considered normal and reasonable.
It would then stand to reason that in order to impede the normal and reasonable flow of traffic, you would have to be driving under the limit when road and weather conditions were perfect.

I do think I remember seeing somewhere that the slowest you could legally drive was 15 under the limit except in certain conditions like snow and ice.
And here's another reason why the cop was stupid and she will win.

She was only impeding in the left lane. Since MD doesn't have a slower traffic keep right law, the traffic behind her could have used any of the other three lanes in which to pass her. She broke no laws.

She really should have moved over though.

No, I drove as fast as I felt comfortable with. The road was crappy and I was not going to speed up so someone could pass. Sorry, but I am not risking mine or my child's life to let someone pass. And yes, I was in the left lane because I was going south on Route 5 and the sign tells "through traffic to stay to the left". I could not have moved over if I want to because the person next to me felt that he/she could not drive any faster either.

Ever wonder why you can pull on the left control stalk and you high beams come on?

In 90% of the civilized world it allows a fast vehicle overtaking a slower one to make sure the slow vehicle is aware of his presence so they can move out of the way.
It's not a challenge
It in no way affects your life if you change lanes and let the faster car go buy.

So why not get over?
because
1) I dont have to
2) most accidents occur during a lane change
3) once over its almost impossible to get left again
4) you are not the one getting my points and fines.. I drive as fast as I can afford in the safest manner, and sometimes, that means Im not going to be in the right lane dealing with the non mergers, or those that damn near stop before they leave the highway.

P.S.
In Maryland, it is legal to pass on the right.

If the car next to you was driving the same speed you could have gotten over behind him.

What if, she was driving along minding her own business, then some car came up, and started pacing her? Is she still the one that should be responsible for clearing the way? or is it the other guy pacing, why should she have to be the one to move? unless she was drving faster than the car in the left but decided to hang next to him when she caught up or something.

I should not have to change lanes on a crappy snow covered road to let some ####### drive faster.

and, you should not be to one to have to change lanes to let someone speed by you, unless you are actually driving under the posted limit.

(For those not familiar, there are signs on the road that show the maximum speed)

You would be amazed at how much smoother and more predictable the driving experience is when everyone follows the same protocol..to the letter. It's so much easier to know that you only need check the lane to the left of you for an overtaking vehicle before you change lanes to the left and that the right lane will be clear to re-enter once you've passed whatever vehicle(s) you entered the left lane to pass.

Again...you "I'll drive like that because I can, neener neener" folks have never sat behind the wheel in any country where driving very fast is routine and the following of safe driving practices mandatory.

Oh I was driving under the limit. I was going 40-45 in the 50 and I was going 30-35 in the 40. Everyone but the jackass behind me was.

I crept down Route 5 a month ago when it was snowing in the evening and the roads had not been touched yet. I had some tailgate me from WaWa to Redgate, even going through Leonardtown because he/she could not get around me due to a car next to me creeping along too. The roads were horrible and I stayed well under the speed limit. Sorry, but I'm not wrecking because you choose to risk doing so. I never drive that slow but the roads were absolutely horrible.
I don't think this is the scenario being addressed.

Having been driving for most likely close to the same amount of time as you have,
you would be amazed at how much smoother and more predictable the driving experience is when I dont drive in the lane where the merging takes place.

When I'm not visualizing actually using my Illudium Q-36 Explosive Space Modulator on the offender dawdling in front of me, I reign myself in and try to imagine how sad their life must be that this, holding up traffic, is probably the highlight of their day.

It makes me and baby Jesus sad.
How sad your life must be that you are always having to rush everywhere you go.
I think, that today, in your honor since its raining, Im going to hog the left lane a exactly the limit just to kick back and enjoy life around me.
Might fire up the pipe, put in a nice CD, and set the old cruise at a steady 54mph.
Gonna print a Bumper sticker that says, Larry Gude Makes me go the limit.

The way people drive around here...sure. I get that. When you are surounded by idiots you have to take a different approach to driving in many instances. A sort of "offensive defense"..

I'm talking about driving places where pretty much everyone on the road actually has some real skill at driving and all carefully adhere to the same norms. Those places are not around here, that's for sure.
