CA Court stealing freedom

We are a homeschooling family so I admit my bias. California is such a radical state I dont really think most of America has any idea what goes on there. It will trickle down I have no doubt. Read and be afraid.......be very afraid.

A California appeals court ruling clamping down on homeschooling by parents without teaching credentials sent shock waves across the state this week, leaving an estimated 166,000 children as possible truants and their parents at risk of prosecution.

The homeschooling movement never saw the case coming.

"At first, there was a sense of, 'No way,' " said homeschool parent Loren Mavromati, a resident of Redondo Beach (Los Angeles County) who is active with a homeschool association. "Then there was a little bit of fear. I think it has moved now into indignation."

I think that's going a little overboard on CA's part. I believe that homeschoolers do need to be somehow registered with the local school district, so that they are accounted for and aren't considered "truant." And I can also see some accountability for ensuring that the children are, in fact, learning, such as being affiliated with a private school or some other program that evaluates the children's learning to hold them accountable.

I once read a homeschooling article that advocated for deprogramming children from a stint in public school, by letting them do whatever they wanted, including watching TV all day or playing video games for as much as a year before actually trying to teach them anything. Which I think is ridiculous. But declaring 166,000 children "truants" because their parents aren't certified teachers is just as ridiculous without taking into account where the children are academically.

"A primary purpose of the educational system is to train school children in good citizenship, patriotism and loyalty to the state and the nation as a means of protecting the public welfare," the judge wrote, quoting from a 1961 case on a similar issue.

Which now a days means indoctrination by the PC crowd in such topics as Environmentalism, Homosexual Lifestyle, Sex Ed ..... and a host of other Multicultural Ideals, that parents that home school object to ........

The ruling was applauded by a director for the state's largest teachers union.

"We're happy," said Lloyd Porter, who is on the California Teachers Association board of directors. "We always think students should be taught by credentialed teachers, no matter what the setting."

A spokesman for the state Department of Education said the agency is reviewing the decision to determine its impact on current policies and procedures. State Superintendent of Public Instruction Jack O'Connell issued a statement saying he supports "parental choice when it comes to homeschooling."

Of course the self serving Teachers Unions would be please, it will force children back into their grasp .............

:faint:

The only solution I see to this is never telling the state school system about your children in the 1st place .......

A juvenile court judge looking into one child's complaint of mistreatment by Philip Long found that the children were being poorly educated but refused to order two of the children, ages 7 and 9, to be enrolled in a full-time school

boy this is the pot calling the kettle black ....... how many children are poorly educated in the State Mandated System now .........

Phillip Long told NewsWithViews.com that he and his wife will probably appeal the decision to California's Supreme Court, since they've homeschooled all of their children, the oldest now 29, because of various anti-Christian influences in California's public schools.

"Homeschooling is endowed upon parents by our Creator. The state of California or the federal government have no right to tell parents how their children should be taught," said Phil Long in a telephone interview with NewsWithViews.com.

This latest court decision granted a petition brought by attorneys retained by so-called "child advocates" to represent the two youngest Long children after the family's homeschooling was brought to their attention.

However, the Long's children did not have any say in their representation by these attorneys. While the lawyers claimed to be representing the interests of the children, they actually were representing the California education establishment. Critics say this is proof positive that in the eyes of bureaucrats parents and families have no rights regarding education.

According to information provided by Phil Long, the trial court had found that keeping the children at home deprived them of situations where they could interact with people outside the family. They also stated that there are people in the public school system who could provide help if there's a problem in the lives of pupils. A judge in the case also said that children in government schools could develop emotionally in a broader world than the parents' "cloistered" setting.

The appeals ruling stated that California's law mandates that "persons between the ages of six and 18" to be in school, "the public full-time day school," with exemptions being allowed for those in a "private full-time day school" or those "instructed by a tutor who holds a valid state teaching credential for the grade being taught."

Phillip Long said his family is working on ways to appeal to the California Supreme Court, because he will not permit the pro-homosexual, pro-bisexual, pro-transgender agenda of California's public schools to indoctrinate his children.

"We just don't want them teaching our children. They teach things that are totally contrary to what we believe. They put questions in our children's minds we don't feel they're ready for," said Mr. Long during the telephone interview with NWV.

"Children belong to the parents, not to the state," Long said. He also acknowledged that there's a great deal of misinformation about the status of homeschooling in California.

So now the state can claim mistreatment if parents aren't putting the children the public indoctrination centers .....

It was only a matter of time before the leftists in California realized that they couldn't brainwash your child through public "education" if the kids weren't in school.

These left libbies sue over everything under the sun, so I'm curious why homeschooling parents wouldn't press their right to educate their child all the way to the Supreme Court.

That fits in well with their latest attempt:

California Dems Introduce Bill To Allow Communist Indoctrination in Public Schools

Yes, that’s right. The headline is no exaggeration. California Democratic Sen. Alan Lowenthal has proposed an amendment to the Educational Code that will explicitly allow the promotion of Communism in schools, and also allow groups who want to violently overthrow the US government to meet on public school property.

Here’s the PDF file: sb_1322_bill_20080220_introduced.pdf

Many observers believe this is merely the beginning of a movement to totally ban homeschoolng because the California Legislature and Gov. Arnold Schwarzenegger worked together to establish Senate Bill 777 and Assembly Bill 394 as a law that institutionalizes the promotion of homosexuality, bisexuality, transgenderism and other alternative lifestyle choices within the public school system.

"The reason homeschoolers are under attack is obvious. NEA and the Homosexual lobby wants them in public schools to indoctrinate them. Homeschooled children are not brainwashed with homosexuality, the myth of global warming, globalism, etc.
Homeschooled children are still innocent and that can't be allowed. Therefore, attacks on homeschoolers will undauntedly escalate across the country unless the Christian community wakes up," said conservative strategist Mike Baker.

"[California] law at first allowed public schools to voluntarily promote homosexuality, bisexuality and transsexuality. Then, the law required public schools to accept homosexual, bisexual and transsexual teachers as role models for impressionable children. Now, the law has been changed to effectively require the positive portrayal of homosexuality, bisexuality and transsexuality to 6 million children in California government-controlled schools," said one homeschooling advocate.

There are no similar protections for students with traditional or conservative lifestyles and beliefs, however. Offenders will face the wrath of the state Department of Education, up to and including lawsuits, according to legal experts.

"SB 777 results in reverse discrimination against students with religious and traditional family values. These students have lost their voice as the direct result of Gov. Schwarzenegger's unbelievable decision. The terms 'mom and dad' or 'husband and wife' could promote discrimination against homosexuals if a same-sex couple is not also featured," said Baker.

"Having 'mom' and 'dad' promotes a discriminatory bias. You have to either get rid of 'mom' and 'dad' or include everything when talking about [parental issues]," he said. "They [promoters of sexual alternative lifestyles] do consider that discriminatory."

Seems to me it would be time to move out of Cali ...... like it is time for Conservatives to leave MD

Gee I wonder how this will jive with Muslims .... all this Homosexual Lifestyle Agenda crap is againist the tenets of Islam ........ hehehe Iran even puts Homos to death, because it is againist Islam ......... there are no Abortion Rights either ........

Considering the illiterate half-wits the public school systems churn out, I'd think homeschooled kids would be their peer in everything except Homosexual Studies and Global Warming Will Kill Us All.

Perhaps, but I'd still advocate for some sort of checks to prevent parents too lazy to make their kids go to school from claiming they homeschool when the reality is they roll out of bed about noon and barely note that their kids are lounging around in their jammies playing video games, and never went to school.

Just to be perfectly clear...(I'm not sure if some might read the above statement wrong)...I'm not saying homeschoolers are lazy parents, I'm saying that lazy parents may take advantage of the system by claiming to be homeschoolers.

I homeschool my children and in MD you do need to either meet with the county once a year or be in an unmbrella group that checks your work and reports to the county. Lazy parents probably don't want to be around their kids 24/7 and therefore probably won't homeschool. But there are always exceptions.

I know Maryland has a system to check up on homeschoolers, but not all states do.

The lazy parents I'm talking about don't really homeschool, it's just a claim some could make to avoid getting into trouble because they don't bother to make their kids go to school. If there is no system to check up on them, they could get away with it.

WDF. So worth the wait.
I homeschooled my children in CA until this current school year. It was a nightmare from the beginning working with the school system.
They give you two choices. You either follow the "private school" route, which includes a multitude of yearly fees or, or you do "independant study". With independant study, you are supplied with all supplies and curriculum from the school district. You have weekly meetings with your advisor, who grades all of the work and critiques your teaching methods. You also are required to provide a hourly breakdown what you did the following week. It is insane. I am not at all suprised by this ruling.
The only good thing I can say about homeschooling in CA is that you are still eligible for county services for you child ie speech therapy.

That is why I'm not surprised. Every homeschooler I knew in CA expected this to happen. The districts go out of there way to make your life hard.

I actually know someone like this. Couldn't ever get kids to school on time so they pulled them out and homeschooled them. Still doing it. Mom sleeps until 10am, kids still in jammies and/or still doing schoolwork at dinner time, playing video games instead of doing schoolwork, etc., etc. Pathetic!

That said, I am all for homeschooling -- for the right reasons, such as those mentioned in the above posts. Nothing California does surprises me and if I were these people, I would pull up stakes and take my family and my tax dollars elsewhere ASAP.
