The Charles County sheriff's office has opened an internal investigation of a veteran sergeant who allegedly threatened a man dining with the sergeant's estranged wife at a local restaurant last month, officials acknowledged this week.

Sgt. Anthony P. McGrath, a 13-year veteran who is the subject of the probe, has not been charged, either with criminal counts or administrative violations. Sheriff's officials said the matter is being handled by the Office of Professional Responsibility, the department's internal affairs division.

"The agency is going to handle it. There is no criminal complaint," said sheriff's Capt. Joseph C. Montminy.

The probe is focused on an Aug. 5 incident at Capt. Billy's restaurant on the Potomac River at Popes Creek, Montminy said. Police were called to the crab house about 8:20 p.m., and witnesses told officers that McGrath made loud threats directed at a man who was with McGrath's estranged wife, Keri, Montminy said. Three sources with knowledge of the case said McGrath threatened the unidentified man's life.

By the time two sheriff's officers arrived, McGrath had left the restaurant, Montminy said. Montminy, who is executive assistant to Sheriff Frederick E. Davis (R), and Capt. Dave Williams, commander of the patrol division, also went to the restaurant so that officers who ranked higher than McGrath would be there.

"If we had to take some action, it would be better for us to do it than some patrolman," Montminy said.

McGrath, 36, has since been interviewed by internal affairs detectives, Montminy said. Officials declined to comment on what disciplinary action, if any, will be taken.

"He screwed up, and we're dealing with it," Montminy said. "It's not going to go away."
