Military service members have been getting the COVID-19 vaccine since late last year, but the shots did not become mandatory until Aug. 24. That’s when Secretary of Defense Lloyd Austin ordered all personnel to get vaccinated.
“Plaintiffs claim that the DoD cannot force them to take a COVID-19 vaccination under existing military regulations, federal regulations, federal law, and the U.S. Constitution,” says a version of the lawsuit filed Sept. 24.
The lawsuit was originally filed Aug. 17 in U.S. District Court in Colorado and the Sept. 24 version has updates based on events that took place since Aug. 17, such as Austin’s Aug. 24 order.
According to their court filings, the plaintiffs are Army Staff Sgt. Daniel Robert, an infantryman at Fort Bragg and Marine Staff Sgt. Hollie Mulvihill, an air traffic controller at New River Air Station.
They are suing Austin and the U.S. Department of Defense, the Department of Health and Human Services..........
