This has been decided in several lower courts too. But that's not to diminish the value of yet another finding. It's nice to see that several lower courts are converging on a single idea surrounding this.

You know, the Navy regs prevented the Chief from assigning punishment details......... You could, as a good sea lawyer, point that out to the Chief...... having the legal right to do a thing is not the same thing as being smart to do that thing.
