Was the drug content in the man during the trial admissible? Unless his face was held straight down to the ground he should be able to breathe like anyone else. I think it was to the side where he could breathe through the nose or mouth. I don't remember though. Think of this possibility - when laying flat, drugs flow faster to the heart and brain. Did doctors testify during the trail? If not, he may have a good reason for a new trail. This could be part of his request.
