I want to go for custody of my daughter and I know Maryland's take on the fathers. I want a good get down and dirty lawyer to talk to. I'm tired of seeing my daughter used as a pawn and my child support used as a pay check for a woman that doesn't care much for her children. We had everything good and civil until she recently quit her job, and now all of a sudden she needs more money. My mother has my daughter most of the time I do not, and I do not feel like I should pay her more money while I can take better care of my daughter. My weekend was over today and she didn't want to go to her mother's house, but she wanted to go to her grandparents. Any ideas?

I'm sorry you are going through this! My custody battle lasted five years and I went through three lawyers, finally fired them and represented myself. I got divorced in Texas so I have nothing constructive to offer on Maryland Law. But I can point out some very important factors that Judges take into account when awarding custody:

1. Are the parents using custody to inflict harm on the other parent?
2. Which parent has the best family support system?
3. Which parent is capable of providing a stable living environment?
4. Which parent is capable of providing financial support full time?
5. Which parent provides the child with their own bedroom?
6. Which parent’s schedule benefits the child’s school schedule? (i.e. work days/nights – If a parent has to work nights then child care must be arranged. And some Judges do not approve of night time working single parents.)

When you do have a lawyer, do not focus on the ex’s faults; do not play the blame game.

Focus on what is in the best interest of the child and how YOU can provide everything she needs. And use the ex’s faults (being unemployed for one) as proof that you can provide a more stable and healthy environment. Presentation is everything. You must appear for all purposes to ONLY care about the best interest of your child.

P.S. Keep a record book of everything- Dates, times, durations of when you daughter is with you, the ex, and the in laws. It is evidence. Keep records of phone conversations and what was discussed.

As far as I know, you will need to prove your bebe's momma unfit. Her being unemployed will not be counted against her, and you will have to convince the judge that this move is NOT to avoid paying more child support. Prepare to answer the question, "If your daughter spending so much time with your mother was an issue, then why didn't you bring it up before now?"

How old is your daughter?

Thanks for the replies, I just want to talk to a lawyer before I go ahead with anything. Discuss my options and go from there. I want to make sure I am well represented unlike the last time I was in court and went without representation. My daughter will be 11 in July.

Your Daughter might be old enough to decide where she wants to live. I'm not sure on Maryland Law. I wish you the best of luck.

Yes 16 in MD, however if a child feelings strongly enough and is under the age of 16 then the judge may interview them to determine the child's wishes and the reasons for them. They do not have to abide by the child's wishes. They will make a transcript of the interview for the record and provide to the parents.

At 16 they may be emancipated, but MD judges will let a child choose at 12 as long as the parent is fit. That's what it was when I went through the custody battle with my parents (24 years ago) and that's what it was a year and a half ago when the bf went through the battle with his ex.
