Deputies responded to a family disturbance call before the shooting took place

The suspect has been identified as 41-year-old Gabriel Batista. The shooting happened around 10 p.m. Wednesday in Davenport. Deputies reportedly responded to a family disturbance call.

When deputies got to the scene, Batista was not there but returned in a vehicle. Investigators say he exited his car and approached deputies with his hands behind his back.

"Deputies asked Batista to show his hands and he refused," a news release from the agency to FOX 13 Tampa Bay read. "As one of the deputies tried to Taser him, Batista shot the other deputy in the chest. The deputy immediately shot back at Batista who threw his gun and surrendered."

well, as I understand it, the deputies are already being investigated for a "hate crime" for raising their voices to a marginalized, possibly Hispanic man defending his right to be a shooter. AOC will hold a GoFMe fundraiser in Little Havana and Ybore City this weekend and the Sheriffs Department will be holding feet wash ceremonies!!!!

Mr. Batista was reached for comment, earlier. Through a court-appointed interpreter, Batista reportedly said "This all just a mistake. I no shoot no deputy. I shoot the sheriff after he breakup with my sister. He break her heart."

Apparently, it was all a case of mistaken identity. The DA said that after review of the suspect's intentions at the time of the shooting, all charges have been dropped.

An out-of-court settlement for Mr. Batista's pain and suffering, as well as the waste of his valuable time at the hands of a racist, white supremacist police department, which entity Batista's attorneys believe intended to kill their client, since, quoting "that's what the pigs do, man; hunt down and kill people of color for fun."
