Establishing is not what the First says. When parsed it uses the word "an" before establishment which means any law with any establishment of religious beliefs as it's result. Passing a law that states the United States is a monotheistic nation is a form of establishment whether there is a government church established or not.
Now if the First said "the establishment of religion", then that would have an entirely different meaning.
Oh, and about the Lemon test, there is already stare decisis on this. The prayer before the shool game decision is pretty strong.
The Establishment Clause of the First Amendment prohibits the establishment of a national religion by Congress or the preference of one religion over another, or religion over non-religion.
At an absolute minimum, the Establishment Clause was intended to prohibit the federal government from declaring and financially supporting a national religion, such as existed in many other countries at the time of the nation's founding. It is far less clear whether the Establishment Clause was also intended to prevent the federal government from supporting Christianity in general. Proponents of a narrow interpretation of the clause point out that the same First Congress that proposed the Bill of Rights also opened its legislative day with prayer and voted to apportion federal dollars to establish Christian missions in the Indian lands.
Clause in the 1st Amendment to the U.S. Constitution forbidding Congress from establishing a state religion. It prevents the passage of any law that gives preference to or forces belief in any one religion. It is paired with a clause that prohibits limiting the free expression of religion.
